Legacy to person drawing benefit

I wish to leave my nephew some money in my will. He is at present drawing Incapacity Benefit and Housing Benefit. Will this legacy affect his benefit?

  • Potentially yes.

    In other words, if he comes into money as a result of such a legacy, the full amount would be taken into account for any means tested benefits. Whether or not it physically affected his entitlement is, of course, dependent upon the rules at the time. For example, if the amount was £85 only, it almost certainly would have no effect. £85,000 would be an entirely different matter.
