Hi I am new to this but i really do need help
I will try and be as clear and concise as possible
I have three outstanding balances with JBW for PCNs but they are asking for over £900 pounds to clear them all. I have had letters from them about a warrant of execution and the other day received a had delivered notice stating that they came to recover goods to the value of the debt - All three combined - There was a single reference number on the letter that was hand delivered along with my name and address and the amount that they wanted me to pay £900+
No other information was completed, not what the debt was for not what the charge was for just this rather large sum of money.
After receiving this i emailed them asking them to clarify this letter that was sent to me and i then received in the post three separate letters for amounts that added up to the sum that was on the hand delivered letter.
I then emailed them asking for a break down of these charges and the warrants...... This is where i get confused
1.There is a charge on all three for attendance to levy that are all on the same date
2. there are only 2 warrants
3. There is a charge for attendance to remove with the same date as the attendance to levy charges
Is this correct ? Can they Levy my car with out it being present at my address or me signing anything ? Can come back the same day to remove it and charge me for it ? The value of my car is under £400 pounds but they wouldnt know the value of it as they havent seen it to know it is highly damaged and does not move over 20mph

they cant charge 3 visit fees on the same day
they cant charge an attendance to remove fee until they have a valid levy (to levy goods they must leave you a notice of seizure/distress listing the goods levied )
JBW will have the registration of your car (its on the warrant of execution) JBW use ANPR and do remove cars regardless of the value of the car (it ups there fees)
I suggest you go to http://www.bailiffadviceonline.co.uk/ this site is a fee paying site i believe the cost of a phone call is 60p per minute but you wont get better advice anywhere
All bailiff company's are well aware that the owner of of this site is 100% spot on when it comes to enforcement legislation she has spent years lobbying central government against underhand bailiff tactics and fees
She is also a member of this and other well known advice sites where she helps out free of charge when she can
I am not in any way connected to the above site and as a rule wouldn't recommend a fees paying site but as you are dealing with JBW i thought you should be made aware of its existenceI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

They should do an affiliation, as thats one phone call i would recommendI all have learnt is from others on many sites.

They need to give you a NTo - Notice to owner/seizure stating that the car has been levied, no paperwork no levy, no fee.
2.They are dealing with all three balances in the same way even tho only 2 have warrants.

Can you please let me have the cost of each PCN that you have had?
The no of visits?
The date and times of each visit?
I will then work out what you need to pay legally for these.

The initial notice to owner sent to me from islington council was for 120 for all the pcns this then increased to 185
the first letter that was sent to me by post from jbw on 6th Dec 2010 and was for one of the pcns and was about the warrants
The next correspondence was the hand delivered paper on the 7th February 2011 at 9am that stated they had come with the intention to remove goods this was more like a form but had no title. At the top it had space for.them to fill in my name and address ,which the bailiff did and a reference number which related to one of the pcns. They did not however fill in the original amount any charges of what the debt was for only their jbw reference number.
After enquiring about this I received three letters one for each of the pcns titled notice of removal . all letters were dated 8th February 2011 and delivered in the post ,In these letters they stated that they will be attending my property with a removal team, enter my property and remove goods and that I will be charged for this . This said I do not need to be home for.the removal but would be best if I was so they could leave me with the notices , removal forms and details of how to pay
two of the letters asked for 272 and the other asked for 441
Other than asking for the break down this is all the contact I have had with them0 -
Ok Each PCN was for £60.
£60 paid within 14 days.
If not goes to £120, if still not paid they charge an additional 50% plus court fee, court fee is £5
Hence you got £185.
After letter £196.20
1st visit £262.12
2nd visit £389.42
3rd visit £469.13
These include VAT
JBW Group Ltd v Westminster City Council [2009] EWHC 2697 (QB) (03 November 2009)
This Detailed Assessment Judgement also makes it CLEAR that a bailiff cannot charge "multiple charges" for enforcing more than one PCN and neither can a bailiff charge a credit card transaction fee of 3%
For attending to levy distress but where the levy is not made, the reasonable costs and charges for attending to levy.The costs and charges are not to exceed the fees and charges which would have been due under paragraph 2 above if the distress had been levied.The costs and charges are subject to taxation under rule 11.
You really need to send letter asking for breakdown of charges, asking when they came to property, if they charge for all 3 PCNs on 1 visit that against the LAW.
Without letting them in they cannot do much apart from levy on your car, again this cannot exceed the charge that they would have got if not levied. DO NOT LET THEM INI all have learnt is from others on many sites.
