in Cutting tax
Right. Last year I worked for a small company for 9 weeks on the CIS card, or UTR, as it is known now.
I was paid every week, in cash, and the normal 20% tax was deducted. I never recieved any wage slips whatsoever. On the UTR number they can give you just a monthly slip. Now, after the 9 weeks the work was nearing an end so I left for another job, and was promised wages slips in the post, they never came!
Now, in a few weeks time, I am due to do my self-assessment online and am usure what to do about these 9 weeks? I have a very strong feeling that this tax was not paid, and am usure whether to inlcude it on my S.A. forms or just say nothing and let it go. If I do claim for it, and it was not paid, will the taxman come after me for the tax?
I really do not know what to do? I do not want the tax man on my case, as I have a 100% good tax record that has been clean since I left school over 30 years ago.
I have found out today that the firm I work for, for these 9 weeks were wound up in Feb this year.

It was the employer's responsibility to hand over the 20% deductions no later than the 19th of the month following the payments to you. Not your responsibility. Hopefully you have raised invoices, or can now do so, showing:
Cost of Your time + Cost of Materials = Invoice Cost.
So suppose your invoice was 1,000 for time and 300 for materials. The deduction will have been 200 (20% of 1,000) and the net payment 1,100.
You should prepare your accounts, and in the box on the tax return for CIS Deductions - box 37 - put the grand total of all of the 20% figures added up. You should find you are due a tax refund because the 20% is deliberately set to over-recover tax unless you earn over £43,875.Hideous Muddles from Right Charlies0 -
I agree with the first reply. To add to that, do you do your own tax return? You may find it worthwhile to use the services of a cheap accountant to ensure that you are getting the benefit of all allowable expenses. All of the subbies who work for us seem to get very healthy rebates, usually at the cost of approx £200.0

OP. When you got the payment, did you bank it? If so you should be able to find out how much you banked each week and as long as it was all banked then you can work out the amount received.
As the company has been wound up it is not reasonableto request copies, so, you may be left with only one option and that is to contact the CIS team at Newry and request the details from the contractors monthly returns.
Do this in writing, and explain that yu have exhausted all avenues trying to get them. Also give the name and address of the contractor (even if it is wound up).
The address for Newry is
CIS Centre, Newry
H M Revenue & Customs
Custom House
Carnbane Way
Carnbane Industrial Estate
NEWRY
BT35 6QG
Incude in the letter your UTR number.
The moral of this story is, don't rely on the contractor fulfilling their obligations. Always, always keep your own records whether that be in a cash book, or on a spreadsheet, come the end of the year it will be so much easier to deal with.[SIZE=-1]To equate judgement and wisdom with occupation is at best . . . insulting.

If you should write to Newry and get a reply, please post back into this thread in 6 months' time telling us about it. They are one of the worst parts in the HMRC system in my experience - and given my general view of HMRC which dori will confirm, that unfortunately is saying something!Hideous Muddles from Right Charlies0
