Over Payment By Employer
I signed a contract where my employer agreed to pay me at a certain rate for a period of 4 years after which the salary would be reduced by approximately a third. I forgot about the date to which the reduction related to. Apparently my employer did too. Consequently they have overpaid me for the past 14 months and are now trying to get me to repay the over payment. It is also complicated by the fact that when I signed the contract I was working for a different employer and was subsequently TUPE'd over to this new employer. My salary is being cut by a third and I am also being asked to pay back the overpayment which means my salary is tremendously reduced. My job title now is a different name to that on the original contract, although the job is essentially the same. Help! Jazz

Hi
Not a good situation to find yourself in. Can I suggest that you contact ACAS, in light of the fact that you were TUPE'd over to your current employer. I don't know if they will be able to help, but as they are expert in employment law advice they may be your best bet.
