Renting while Bankrupt

Hi guys, looking for a little advice/information about privately renting while Bankrupt.

My partner and I filed for Bankruptcy last year after we were forced to move out of the house we owned. We've been living in a family members house (paying proper rent/bills etc) for the last year or so.

We now need to look for somewhere else to live and have found a property that matches what we currently are paying. This is a private let and the landlord has noted that we would need a bond and references, which we can provide.

Am I obliged to inform the new landlord of our Bankruptcies? We've had no problem in paying our rent where we are and would be able to provide a guarantor. But we are both really worried that they might refuse us instantly because we are bankrupt.

This house is in a perfect location for our daughter who is starting nursery in Sept and for my partners job.

  • If the LL asks you to perform a credit check, then you are better off disclosing all adverse credit history beforehand & explaining it's existence...

    If the LL just requires references, then under Data Protection, you have no need to disclose unnecessary information, unless it has been officially requested?

    Unless you are still undischarged, in which case you should maybe ask your Accountant/OR?

    I know with Scottish Sequestration, they ask on the original application for your Landlord's details if you are renting, as they then write to inform him/her...

    LL hasn't asked for a credit check, or indicated that one would be required.

    I'll need to inform the OR that I'm moving anyway I would think. I'm not discharged until August, so they would probably need to see the tenancy agreement anyway - just not sure if they would have to contact the LL, seeing how I'm already Bankrupt and are sticking to the incoming/outgoing that was given when we went Bankrupt.

    Could do with some good luck on this either way!
  • Ooo, then I'd ask if they're going to contact your new LL to inform them, and if it's not some sort of legal requirement... Then I can't imagine why you'd need to say anything.

    It could potentially rock the boat for no reason really.

    Well the LL has now asked for a credit check!

    So have replied with our situation, offering to show bank statements to show the rent/bills that we've been paying in our current house and also offered a guarantor, for their reassurance.

  • I'm midst application for my BR & was totally honest about all my adverse credit etc, it was done through Homelet & got based on my partner's references rather than my shocking credit history in the end. If you can prove you have never been late paying, or been evicted etc, then it could be ok?

    Who is the credit check with? Sometimes it's just an identity thing & LL don't have access to all info on your file.

    Honesty is the way forward though, a pre-emptive strike as it were, you want to be seen as open, honest, reliable & committed...ommiting something major might look suspicious to a LL... x
