Vodafone CCJ?!?!

Right my partner and I are trying to get a mortgage,
However we have been declined and luckily our mortgage advisor managed to find out why, apparently my partner has a CCJ against them from Vodafone, however we never received any paperwork and the debt was paid off in December 2008, which Vodafone acknowledge, On the credit report Vodafone shows as a default but there is no mention of a CCJ, so this has to be a mistake of some kind, anyone able to offer any advice on how to get this resolved.
I have contacted Vodafone and they confirm no money is owed to them.

Not sure if filing a stat dec would help as over 2 years ago. You can try.I all have learnt is from others on many sites.
Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.

Sounds very odd....
Did they get any details of the court/case number when they found this out?
Otherwise you can check with www.trustonline.org.uk to see if there is a CCJ listed against you. Costs £8 though.
So according to vodafone they or a DCA acting for them didn't obtain a CCJ? And vodafone confirm that the debt was paid off in full by you to them?
If that is correct, any CCJ is either not actually there or has somehow been made by mistake? Miscommunication between vodafone and a debt collectors they were employing perhaps?
If you can confirm that there really is a CCJ and that the debt was paid off in full, then you may well have good grounds to get it removed or set aside.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

First thing first is to get a copy of the credit reports and find out exactly what it says, and when. Then take it from there (go for the £2 statutory reports it's cheaper).0

Hello, OK
I did a check with www.trustonline.org.uk they say there is nothing, www.creditexpert.co.uk just shows it as a default, so I have no idea where this mortgage company got their information from.
Slightly confused but very relieved, I assume that means everything is alright? surely if there was a CCJ at least one of those would show it?
Thanks so much to everyone who gave addvise it is really appreciated :-)0 -
Maybe someone got their wires crossed, and the default got mistakenly noted as a CCJ by someone in the application process? Hard to say really?
The registry trust is the official register of judgements, so as long as you checked the correct name and correct address, then finding nothing is reasonably conclusive.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Well I have asked the mortgage advisor to go to a different company, I am really angry because we asked for a mortgage in November but they turned us down, turns out they turned us down because of the phantom CCJ, now I learned yesterday the house is under offer from another buyer, I am so so so angry!
So we are trying to get a AIP today so we can offer more on the house and hopefully they will accept our offer...
I am also suprised that the mortgage company told the mortgage advisor why they turned us down, I thought they werent allowed to... somethng about breach of privacy etc, I am actually happy they did as we now know that it isnt anything on our report and just a mistake by the mortgage company.
Alls well that ends well I suppose.
Thanks for your reply everyone and thank you Vodafone for you offer of help, I have sent a letter to Vodafone regarding the default, so if I get no help there I will email you.
Thanks again everyone0 -

You're welcome donny84.
Have you received a reply to your letter yet?
If not, and in order to try and get things quickened up, could you send us a quick email via the Contact us form which Jenny linked you to and as well as quoting WRT135 in the subject line also include FAO Lee?
Once you've sent it and received your automated reply could you then update the thread with your email reference number and I'll get back to you as soon as possible?
Thanks,
Lee
