If MH are collecting the debts, then my first instinct is to check whether the debts are actually legally enforceable?

i.e. Could they be statute barred? Or never had a credit agreement when one was needed?

    How much is "small"?

  • definatley enforceable - from my stupidly taken out quickquid loan last year before i had my lbm - i dont want to weedle out of paying but as the original advance was something like £250 and then it went up to £387 I dont want to pay them lots of money just made up from charges unless I can really help it - the amount owing at the moment is about £370 - and paying £5 monthly to them at moment through cccs dmp - was thinking about offering £150/200ish but dont really want to give them more than I have to as they have had so much already!!!!

    Any advice/success stories greatly appreciated:)

    Hi makemedebtfree,

I'd offer them £100 to begin with, but make all offers in writing and only settle with any dca (especially muck hall) if you have received a letter saying the agreed amount is as a full and final settlement of the debt. There is a template letter for settlements on the national debtline website. Explain in the letter that the money has come from a relative, so they can't come at you for higher payments or the entire amount.

    Good luck

If debts have been passed to MH, they won't be enforceable - and this is a company I do know better than most.

They don't do 'enforceable'. I'd either send the 'prove it' letter or a CCA request (don't put a signature on the letter!) via recorded delivery and wait and see what happens from there.

I certainly wouldn't offer them any payment at this stage - especially not a F&F. They WILL sell the balance to someone else to chase up later on, so I really can't see the point of a F&F to them.
  • I do want to pay back what is owed but I dont want to offer f&f if then gets sold on to someone else, I think I will send them a letter offering £100 to start with and definately wont send them any money until they confirm wont be sold on/chased by another company and is taken as full and final settlement of account - will have a look for the template letter to send
