Help with old Debt

Hi

Sorry to bother you guys who must hear these questions all the time!!

Anyway, I have recently had contact with Lowell.

They sent a letter saying I owed Nat West £1100.

This was an old debt from around 2002 so I sent the Statute Barred letter.

Anyway they have replied saying that I made a payment toward the debt in 2006.

My life around this time was pretty hectic and I have no recollection of making this payment. Is there any way I can ask them to give me details regarding the payment?

I know for example that at the time I did not haver a debit card.

    I would just write to them stating that you have no record of this payment and require them to prove this.

    You could send a subject access request (SAR - cost £10) to your bank if they are not willing to look up their records to confirm this. The SAR would allow you to have a copy of all data held on your which should include statements which should show this transaction.

    I would ask for proof of this payment though so you can see the amount and when this was.

  • By doing this will the clock be reset regarding the debt being unenforceable after 5 years (I am in Scotland)?

    Even with that payment the 5 years would be up in a month.

    Also, is there a template for this letter?

    The prove it letter is not an acknowledgement of the debt. I agree with Fermi though - save the postage and use it for the SB letter.
