Okay so i recently got a letter from Cap quest. I have never heard of them whatsoever and they say their client is Capital One. I had a credit card with them 2-3 years ago. I had some problems paying for it but in the end we settled a payment of £10 A week for 2 years. Anyway that was a long time ago and now the letter is threatening me that "your account will then be passed to our solicitors for legal action on or about." I also have an opportunity to make a final payment of £182.24.

It carries on saying "Should the litigation process be instigated and a judgement is granted we would seek order of the court" i'm not an expert so i don't know what they mean.

Then it states "The bailiff will take an inventory and may levy foods. You will be informed if the bailiff has impounded any goods and you will be asked to sign a walking possession agreement, acknowledging that the impounded foods are in possession of the bailiff. If full payment or a satisfactory offer of a payment plan is not made, the bailiff is authorized to remove goods for sale to pay debt and costs" the quite scared me, Can they do that? It also states it is within your interest to contact this office by 16 march 2011,

So my question is.
Can they do any of this?
Whats a walking possession agreement
Is this a scam?

    The letter is just trying to make things sound superscary. Yes, that's what would happen if they had to take you to court, secure a CCJ, then you didn't pay the court, and they had to appoint bailiffs. Lots of ifs there.

    But you dispute the debt, you say you agreed to pay it off, then paid £240 to pay it off. Find all the paperwork, records of your payments etc from that time and agreement, send them photocopies
