Bailiff visit dye on monday

Hi all,
My friend Called me I'm a complete panic this morning about an impending bailiff visit. Much as I know a little about debt law etc I don't know enough so thought I'd ask you.
She had done a uni course which was provided by an external company who chased her last December for outstanding fees. She didn't realised she owed at the time but once it was explained made sense of it and started a payment plan.
Payments could only be done by cheque do at their request she sent 3 post dated cheques. So here's the problem: December went out ok but none this year have. she's checked her bank statement and there was plenty of money in her accounts when the payments were due so they didn't bounce and there have been no bank charges to reflect a bounced cheque.
They're due to visit on Monday so she's foot proof that money was in her account when the payments were due. She van pay a couple of hundred and I can help but the full amount of £1150 can't be done. she's left answerphone messages with the bailiff contact and spoken twice to the solicitors today.
Any advice given about the situation would be very gratefully received.
Many thanks

does she have a CCJ against this debt
does she own a car not on Finance or HPI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites
If you are in any doubt please seek legal/expert advice help0 -
Don't let them in. Won't have any leverage otherwise.0

Has she proof the post dated cheques were sent? Were the cheques dated for each month (dec, Jan Feb etc) ?
If so I would think it would be the companies fault for not banking them? I'd get her to check if the cheques have actually been banked (and if not, cancel them)Here to offer help and advice, and maybe take a little in return.
Whilst I am happy to share my knowledge, I am in no way a professional... I can not therefore accept responsibility for inaccurate info, I ask that you take professional advice rather than rely totally the info provided by myself :beer:0 -
One thing to check as well is that all the cheques didn't just go out at the same time in December, as a rule banks don't check the dates on the cheques and don't recognise post-dated cheques.DFW - DEBT FREEEEEE!
Total - 10762/10762
Every silver lining has its cloud.0 -
If she has not been to court and does not have a ccj against her then they will not be bailiffs.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Which company is this? We'll then be able to differentiate if they are bailffs or run-of-the-mill debt collectors (there is a world of difference between the two!).0

Hi there,
Thanks for your responses. She initalky got a letter in December out if nowhere about the fees which said she had 6 days to pay or a ccj would be entered against her. She called them and made an arrangement to pay and she thought she had one. However she was on creditexpert about a month or so ago and there was nothing listed on her file. It was strange at the time because she hadnt been informed of anything but one day had an opened envelope by the main entrance to the building which was dated one month earlier. So it either looked like an elaborate attempt to make her look as though a neighbour has opened and kept it....or a neighbour gad opened and kept it! She's moved house now so they'd be visiting the wrong house.
She doesn't have proof of sending the cheques but the frustrating thing is that if the first one was cashed then the others were received. She's got bank statements and there was plenty in her account in thr dates they were due to go out. She's called the solicitors again who said they'll accept payment of the missed payments and they'll contact thr bailiff about her having moved.
I think they're Court Enforcement. I'll double check thr name. Either they or thr solicitors are based in Swansea.0 -
Oh and there's no car available. So no ccj shoeing on her credit file as of early February. I presumed it'd show by then if she had it set against her in december. Do these things take a while to show?0

If you have a letter from them, there'll also be a phone number on it presumably (do NOT call it though, for any reason).
Do an online check for the phone number and you'll find out other peoples' experiences of that particular firm.0
