Cabot- Telephone question

Good Morning
A few weeks ago I sent the telephone stop letter to Cabot. The calls have since stopped. all good.

They wrote to me yesterday in the most condescending tones possible, saying that they will not ring me for 28 days, if in that time ihave not complied with thier request ot fill in a budget form and payment plan then they will start phoning again wiht any number that they have available to them. CAn they do this?

I am dealing with this debt, they only want a review. Thereis another debt that they are trying for that I am in dispute over (JD Williams who ahve doubled the debt through charges) so I am in the process of Prove it etc with them.

Please help as I don't want the calls to start again:(

if they start phoning again then report them to the oft and trading standards

log time and date of all calls
  • Do as they request and they will have no need to call you.

If you di as they request and they call you, submit a complaint to them. If you fail to receive an apology, take it further, like ombudsman.

Actually, they cannot call you on 'any number available to them'. You have provided them with a means of contact and are paying your debt.

If they are asking for a review, write back to them explaining that your financial circumstances have not changed, and that your payments therefore should not be changed. You are not legally required to send them any documents, but if you complete the forms do not include any personal details like bank statements or account details, and do not sign the letters, just print your name.

Remind them that you have requested that all communication be in writing, and that if they do try to call you again, regardless of what they say, you will report them for harassment, as they have an alternative method of contact.

    Good luck

Whether the account is with the original creditor or not if you request your telephone number to be removed from your account and request a creditor contacts you only by post they are obliged, by the Data Protection Act, to do so. You need to make this request in writing and send it special delivery mentioning that if they do not remove your number that they will be in breach of the DPA and you will report it to the Information Commissioner. If they do not do as you ask you can make a complaint to them, again mentioning the DPA and Information Commissioner, and if they still continue to call then report it.

Your creditors do need to have contact details for you, but an address is all they need.

If they have anything important to tell you they need to do it in writing anyway, as do you to them. You need to know what is going on with your debt and who is collecting it at any given time, so the payments go to the right place

    thank you.
I didn't think it was being unreasonable as i have been paying this account for a year, they did not write to request a review just continuously called. As for the other account, until it gets past prove it i am not setting up an agreement as i am not repaying unreasonable charges.

Getting ready for round two then!!

I'm getting a bit !!!!ed off with this kind of post. This company pestered me a few times a day, when my wife was heavily pregnant, and I needed to report it to the police. When it eventually turned up at court part of my defence included harassment. They were awarded nothing. In fact I was awarded costs :T

    Dear cabot

You were instructed to cease telephoning me by letter of <date>, which you acknowledge in your letter of <date>. However, you are presuming that you are above my clear and explicit instruction to cease all contact by telephone, in that you state that you may resume calling after 28 days.

This is clearly in contravention of the instruction you were given and you are warned that if ever you attempt to make contact by telephone then this will result in any and all legal remedies being taken up without further warning.

You should note that you are instructed that all contact is to be made by letter only to <address>. You have no need of or right to any means of contact beyond this and all data in your possession relating to any other mean of contact must be purged without delay.

    yours

Should be able to prove the debt is owed by the goods delivered, admin fees would be on your online account which by placing the order you agree to and will be on your statments.

You are on the wrong board. I think there are forums for those who support the debt recovery industry ;)

Thanks DV for the letter., I shall keep it there just in case.

With regard to thE JD Williams debt. I have tried to pay what I owe and the admin fees that are fair, but the comapny and the DCA have made this debt nearly 150% more and cannot always agree on the figure. I am willing to face my debt nad pay it, in fact I am long way down the road with some, but I will not pay unfair fees or deal with incompetence when I get several letter in one day telling me differeing amounts and their fee structure seems to change with the wind.
The 'pestering' on the phone borders on harrasment nad their letters are patronising and rude.
We are in debt, not sub human.

    Rant over!
