Getting a CCJ set aside?

I've jumped over from my normal home on the OS boards, so I hope I've landed in the right place.

Just checked my credit report and it's showing a CCJ from 2008. The reference is for a car insurance claim where I was found to be at fault (rear end bump), but I think I'm correct in saying the insurance peeps should have settled that and I shouldn't have a CCJ on my file if they were late paying it?

I'm going to try and get it set aside, but in terms of the order to do things in, should I try and sort it myself with the court, call the insurance company and try to get them to sort it, or get in contact with the Financial Ombudsman people (all of these routes have been suggested and I'm not sure which is the best path to go down).

Least I know why I got turned down for a new CC - every cloud, eh?

    Did you receive a County Court Summons? There are only limited reasons why a court will set this aside. Thinking an insurance company is paying your claim isn't one of them.

    If you didn't you will need to pay a fee and complete form n244.

    If you did, and you still want to try and get it set aside, you will need to get a case together. This will include a letter from the Insurance Company explaining why they did not pay on time.

    Thank you - I did receive a summons - but on letting my insurance company know that it had come to me rather than them, they told me to ignore it. I thought the matter had been resolved 3 years ago.

    I have had a bit of an investigate myself, and have come across several people who have been in the same situation and had their judgements set aside.

    My question was more about the order to do things in, rather than the validity of my case.
