Help - Received Interim Charging Order

Hi - This is my first post but have been reading on here for a while now. We have received an Interim Charging Order from Eversheds for a CCJ which was allegedly granted at Cardiff CC on 20th January 2011. However we have not received this paperwork so unable to respond. Can anybody advise what we should do next as the letter refers to a hearing on 8th April in Cardiff.

We are currently on a DMP with Payplan.

    Check out the NDL web-site and see if you can overturn the CCJ. That may allow you to negoitiate a payment scheme.

    If you have a CCJ, you will probably have to pay more to the creditor and less to Payplan.

    Did you recieve no paperwork at all that proceedings were being issued?

    Yes we did receive paperwork which we signed and returned in time, however that was the last we heard until today.

    Ok, so you had no notice that they had applied for the interim order?

    Is the property jointly owned, but the debt in one name only?

    No, and the Property is in joint names. The debt is also in joint names.
