Hmmm, pretty sure they are getting this wrong somehow

Morning,

I have been offered a job working mon-fri 6 hours per day, now I have worked part time for best part oft adult life due to kids and usually when they try this one I swiftly correct them, however I gave been out of work for 4 Years so things may well have changed.

Now this company are trying to tell me that because I do a shorter day my holiday entitlement will be shorter?!? When this came up before many moons ago with another company I was told that regardless of the shorter day I am going into work 5 days so entitled to the full entitlement and tbh in all my 5 day, part time jobs I have always had the same holidays as the full timers, it's only if I say work 2 days per week then holiday is pro rata.

The other question is regarding minimum holiday entitlement, I thought I had read somewhere that it was now supposed to be a minimum 22 days, I may be very wrong on this one but just want to clarify this either way.

    Minimum is now 5.6 weeks or 28 days for 5+ days per week.

    This can include bank holidays.

    But you get the same as the full timers so find out what they are on and make sure it is 28+.

    You're entitled to 28 6 hour days - bank hols may be included in that.

    If you are working the same quantity of hours each day for 5 days then effectively you get exactly the same holidays as full-timers (am assuming full time is 5 days a week) it's just that your "days" are shorter than a full-timers "days" i.e. yours are 6 hours; theirs are 7.5 / 8 hours.

    Certainly at our place someone working your pattern would get the same entitlement as a ful-timer (at ours it's 22 days plus bank holidays - stat minimum is 28 days including bank hols). As your days are all equal length there's no point in working it out in hours. If you were doing 3 days, equal hours you would get 3/5 of the holiday allowance (in days)

    The only time we calculate in hours is if an employee works different hours on different days - and this is regardless of whether they work 3 or 5 days a week.

    So that would mean 21 days minimum before they add on the bank holidays? I worked out we have 7 BH days
  • 20 days plus 8 BH - Bank holidays are New Years Day, Good Friday, Easter Monday, May Day, Whitsun, August BH, Christmas Day and Boxing Day (plus the royal wedding this year)

    We have 8 bank holidays (and an extra one this year - bit it can be included in the 28 depending on contract)

    where do you live normaly it is 8.

    NY, Good friday, easter monday, May 1, May2, Aug, Xmas, BD.

    There is an issue with the numbers some years if the holiday year is 1april/31st march.

    You should be getting the same holiday entitlement as everyone else who works there, but the min is 22 days including BHs so could be lower plus BHs as mentioned above. At our work it is plus BHs, so it just depends on your work policy

    It depends on how your contract is worded - it has to be a minimum of 28 days including bank holidays, but it's up to your employer if they just say '28 days including bank holidays' or '20 days plus bank holidays'.

    The latter wording would mean you get an extra days holiday this year for the Royal Wedding, which you wouldn't with the former (unless your employer is feeling geneous)
