Lloyds TSB Loan - Person added to loan without signature or agreement
Hi,
I have just received a letter addressed to myself and my partner regarding arrears on a loan that is being taken care of as part of my debt management plan.
My concern is this, I was the person who entered into the agreement with the bank, not my partner. I was the person who the credit check, etc was carried out on. I was the only person who signed the agreement with the bank.
Where do I stand on this matter? To me, this is a blatent breach and disregard for data protection by making another person liable for a debt which they have not agreed to and also discussing details relating to the loan when the other person has not signed the agreement or been made aware of the agreement. For all the bank know, my partner and I could have seperated at the time the letter was sent as the loan was taken out over 2 years ago.
Any advice is appreciated,

It is not clear who sent you the letter?
Is your partner in any way involved in your debt management? Do you have any joint accounts?0 -
The letter was from LTSB, my partner played no part in the loan whatsoever, and we did have a joint account that is also currently under dispute due to SCM solicitors coming to an agreement with me then back tracking on that agreement.0

your partner is not responsible for your debts
from the way you tell the tale then Lloyds can't make them responsible
have you spoken to them; what did they say?

Speaking from personal experience with a debt management company....
BE SURE they are paying the DD or suchlike, the one I dealt with were not, consistently, month after month. Subsequently charges built up and action was brought against us. All of which said company is now recieving nothing short of hell from me.
Secondly, read the guides on here. Follow the steps, get organised etc and you'll soon realise that a debt management company is a bad idea.
On behalf of my partner she is 10k in debt, with a debt management company she went to that went up to 13.5k!!!! Plus a £15 per month account charge, plus £10 everytime she used the card to withdraw or pay for anything.... I wouldn't call that debt management!0 -
This letter doesn't relate to the joint account, the figures are too different and the agreement number doesn't tally with the joint account.
I haven't spoken to them yet, that was for tomorrow. Better to be prepared, I've already opened a complaint with reference with the ombudsman incase I want to go down that road, which knowing past experience with LTSB, it will.0 -

Sorry, I thought that was answered in my post after where I mentioned the joint account was in dispute and that she is in no way involved in the loan, I will expand that to she is not involved in my Debt management plan, if she was it wouldn't be a debt management plan, it would be an IVA.0

Did the letter actually name her or was it a simple Mr & Mrs Ellett ?
I would have thought if they were holding you both responsible, she would have received her own letter.
For my joint Mortgage, we both get copies of the same letter.0 -
the letter was addressed to both of us, in my wifes maiden name.0
