welcome finace - Lewis group

hiya,
so here goes, had a car with welcome finance on HP, lost my job and ended up in £600 areeras, spoke to welcome finance and they said that i could hand the car and have nothing else to pay as id paid more then half off, (unfortunatley i did not get this in writing)
heres the problem, they keep asking for £4000 off me which was the amount i had left to pay over the following 18month if id kept the car, and now its gone to the lewis group who are demanding it and threting court!!
any advice would be great thanks

Hi Kirsty, if the amount outstanding if you had kept the car was £4000, and you have handed the car back, they obviously have not reduced this figure by the amount of money they gained by reselling the car. They are legally obliged to do this. Welcome finance did the exact same thing to me, when I questioned them about it, they told me that they had to scrap the car, and so did not re sell it. I did an online car check, and discovered they were lying because the car was still on the road and had obviously been resold. I then complained to the financial ombudsman, and they investigated and welcome backed down. Im not sure about what you say about having paid half off so you dont owe anymore, but thats certainly worth investigating as well.0

well according to them they got £1500 for it. it said in my contract that if i paid more than 1/3 of the contract i can hand it back without anymore payments.
i just want to know where i stand with having to pay this back as i dont want a ccj as im looking to buy a house next year0 -

also, what are the chances of the lewis group having a copy of my original agreement with welcome fininace? also if they dont have this what does that mean????......is it unforceable????? or what?? i dont have a clue!!!0 -
Welcome are cowboys and Debt collectors dont really care too much about laws.
Might I suggest you have a look here where you will see them trying it on with lots of people, might be worth you joining up and asking, I think its fair to say its not a suprise that they are trying it on.
