Scotcall, provident and Credit Card

Hello, first post so please be gentle with me if I have posted in the wrong place.

My girlfriend took out a Provident load a few years ago and got into a bit of trouble trying to pay it off and what with them not turning up to collect etc the debt has now ended up with Scotcall. I believe Scotcall are acting as agents, I dont think the debt has been sold to them.

When she contacted them they offered to reduce the debt by 25% if she would pay it off in a lump sum. I agreed to pay of the lump sum providing they gave us a letter that stated this was for settlement of the debt which they duly did after much moaning about it.

The letter did not state Full and Final settlement, but did state the original value and the offered amount being for settlement, so in my mind that was pretty clear cut and I paid the debt.

Now after looking at her credit file we find that provident have two accounts showing on her file, neither of which have a similar account number to the one quoted by Scotcall. Even the values of the two accounts do not add up to what the original debt was being collected (it was close) however it seems the Provident are not very good at updating the credit file so this may be the reason.

What I plan to do is wait for a bit to see if the credit file gets updated, if it doesn't, I want to know can I then demand that Provident update the record or threaten them with demanding a refund on the credit card I made the payment on?

Any help or advise would be appreciated.

  • you cant as i see demand any refund from the cc,how long have you already waited for the update?have you spoken to scotcall or provi?have you spoken to the cra`s?

    well I have only just paid the debt tonight so have a bit of a wait to see if the credit file gets updated.

    I was just wondering with regard to the credit card if I can prove that we were made an offer of payment that I duly paid, that if they did not keep their side of the bargain, and clear the outstanding debt, that that was enough to claim a refund on the credit card.

    Surely that is equivalent to obtaining money under false pretences?

    I am kind of hesitant to contact Provident in case we open a can of worms and we/she owes more than we realized. I would have thought they would have been chasing for payment of all outstandig debt by this time though, as this goes back to 2006 when she took the loans out.
