Hi all

My husband is getting hassled from Morgan Stanley. Actually the debt has now been transfered over to a credit company. £1k, owed.

We have listed all the incomings and outgoings and said that we can only afford £20.00 A month until our circumstances change next april when wftc will be a bit better. They are requestinh a monthly payment of £60.00, we cannot stretch this far. We are getting bombarded at least twice a week from them. No-one in the family we could lend us this money or even getting credit as we haven't got a grand score. We are being very truthful but they don't seem to be listening.

Any advice would be great. Can they send the bailiffs ??

  • Having same problem with MBNA - 3 to 4 times a day phone calls from India. Financial statement sent and they still want me to stretch to another 40.00 per month. Threatened with everything but CCCs said that no baliffs can turn up unless you have been served with CCJ and you default. I hope this is right - someone will be along to help further.

    We did have the debt with the cccs up until dec 2005 but due to a lot of financial worries we had to pay it ourselves. We did do the right thing and informed them though.

  • just make your payment of £20pm send the your soa when they phone just repeat what you have already said say thankyou and good bye only make your £20pmonth payment until you can afford to up it if there calls get too constant just hang up dont enter in to chitt chatt make your payment and stick to it they will soon get the message

    As other posters have said, stick to your guns, if this is all that you can afford - you can't magic the money out of nowhere. If the phone calls do get very frequent, there are templates of letters on the site that you can send insisting that communication only takes place in writing.

    As other posters have said, no baliffs can be sent unless approved by court. If they do take you to court, from what I've read elsewhere, the judge will take into account your income and expenditure and if it is reasonable, won't force you to pay anymore.

    Given the relatively low sum of money owed (I know that it doesn't seem like that to you at the moment) and that you've indicated that you may be in a position to pay more in the relatively near future - would it really be in their interests to push you further just now?

    Most of us have been in the position that you are just now. It is really tough when you are going through it - but remember that these people spend all day trying to push people to pay more and more. It really gets me. Do they think that if we had more money we wouldn't give it to them to get them off our backs???

    Thank you for those kind words. Am sure by tomorrow morning we'll have another call so we'll tell them just that.

    Oh by the way, this credit is the smallest one all the others have been okay so far. We are hoping to reduce and pay everything within 4.5 years. ( husband changing jobs so fingers cross, these will be our first priority.

    Also, as I cannot get of this site I have now decided to do a SOA and forward this sometime today. Have done many cut backs but any advice would be great.
