Once the summons is issued the council can recoup any costs which have been incurred/will be incurred in the recovery process by adding them to the balance due - this is quite legal - and then recovering that amount via the liability order. You can in theory attend the court and dispute the costs but the magistrates will have been consulted in advance when the fees were set to agree they are reasonable and they have no objections.
The council do it this way so that the costs are recovered from those for who they have been incurred rather than spreading the cost over everyone's council tax.
so who does the £65.00 court fees go to if i pay the £127? surely there would be no point in going to court if the council had all their money. What would they be chasing me for if it was all paid and then if it didn't go to court the council would take that £65.00 for themselves0 -
The costs are a mixture of court costs and the cost to the council of running a recovery system - issuing reminders, second reminders, final notice, summons etc + the associated infrastructure costs the council .I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
