hi, sorry I don't know if i'm posted in the right place as I have never posted before but was hoping somone can help.
I recieved a letter from capquest demending £169.94 in relation to natwest stating they would take me to court, the letter was addressed to mrs instead of miss. I wrote to them with the prove it letter, to which all they said was it related to a savings account opened in 2003.
Next I sent them a cca request which they responded that a savings account does not fall under section 74 of the consumer credit act 1974, so they are not obliged to provide an agreement for the account. They did send an assignment notice telling me it was assigned 31 may 07.
I dont know what to do next as I do not remember opening this account but I do have a current account with natwest. I have never been a Mrs either which concerns me although I know this could be a typing error on either companies part.
Should I just pay this or do capquest have to prove the debt is mine?
thanks

Sorry no advice to give but... i didn't realise you could get into debt with a savings account??0

well I was thinking that aswell0

I guess it might be possible if someone paid in a cheque to the savings account which bounced at a late stage (and after the money had been withdrawn).
However it does all sound a bit odd. Have they provided you with anything that says what address the savings account was opened at in 2003? (Any chance it might have been your mother's in you lived with her around that time?)
I wouldn't pay until you know the debt exists and is yours.
You could ask for information as to what address the account was started at and also a statement of account for the savings account.
Have you had your natwest current account since before 2003?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
In 2003 I would have been 17 living with the parents so no my current account. All capquest have said is " The account relates to a savings account opened in 2003"0

Essentially they still haven't provided you with any proof, just saying its a savings account in 2003 is useless (and certainly not proof).
I would probably write another prove it letter using the main template but then add in something to state specfically that you have no knowledge of a savings account opened in 2003.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Surely to open an sort of account (Bank or savings) you would have need to sign something?0
