I can appreciate what you say there and you are correct, i would have just turned off if they started to reel off all the details over the phone.

I am not getting the answer i was hoping for but all your points are valid so I can see that I could owe the £50 and that it would be in my interest to pay it.

But, my second question still stands, Can a debt collection agency add £44 to what i owe and come to my house to recover goods to the value of my debt?

No, they will be doorstep collectors not bailiffs. They will have no right of entry into your house so tell them to go forth etc.

You should also report the DCA to the OFT for misrepresentation of their legal position.

But as pointed out, I think you are in pocket with Swinton. Pay them direct the £50 and the DCA can go and whistle for the £44 charge they have added (which they probably can't add if there is no contractual provision for them to do so - check your Swinton T&C's).

The charge also has to be fair and proportionate to the debt so £44 for a £50 debt I don't think so!
