    Set up an agreement if you want.

    Personally I think you're chatting bangers and got gripped in the end. I don't blame you because I'd do the same as well and hope for the best.

    It's funny how hard it is not to see extra money coming in but easy to spend it over a few months.

    Well yes you do is the short answer.

    First of all, ask them for a breakdown of payments made to you and check your bank statement to see if they tally.

    Then, offer a repayment plan of what you can afford. I see you earn nearly 36K ish so you can afford it.

    You'll get advice along the lines of "offer a pound a month" and "daft employer, fancy still paying them" but look at it this way : If you had not been paid your salary and didn't notice, would you still be owed it? Theres your answer.

  • Yes, of course you have to repay them. The money was for work that you did not do - it was a mistake. If you do not reply to them, then they will take you to court.

    Question is, how can you 'overpay' 5k on your credit cards that 'you did not know you never had'? Obviously you did know you had it as you have spent almost 2k per month more than you had in your budget. I think you know that you have been busted and have learnt a very expensive lesson.

    If you do not have the money, the best you can ask for is repayments but if it is for 5k or less, they can take you through the small claims process and you will be charged more for interest and court costs.

    I never questioned if i had to pay them back, i questioned if i had to pay them back in full. I am not a thief, and would never think about keeping money which i knew was not mine.

    If you have nothing helpful to say, it's best not to say anything!
  • I have to agree with the others so yes you do have to pay it back.

    How did you not know that there was extra money in the account if you say that you have been using it for your credit cards?

    Earning 36k and did not notice and extra 1.5k a month in the bank account and spent it all. That is a very expensive lifestyle to maintain.

    Not sure where to start but here goes:

    I worked for a large accountancy firm from the start of 08 - till end of 10 as a PA. I resigned and took my remaining hoilday as my notice period. I did not have another permenant job to go to, so registered with some agencies, between 2-3 of them they have kept me in full time work, I am still currently temping at the moment.

    I have received a letter today from the accountancy firm, saying that I did not comply with the leaving/resignation procedure, and due to this they have carried on paying me. Firstly, I did comply with the procedure, filled in the correct forms/returned all IT equipment back to the correct deptpartment etc, so I am not worried about that as i have the proof needed to say i returned it.

    But I did not realise that they have been paying me since I left, they have been paying into an account which at the time i did use as my main account but since leaving them I have changed to my joint account with my other half. I must admit I am useless at checking the account and as long as i don't recieve a letter from the bank saying that DD have been returned due to lack of funds, I never bothered to check on it. I have looked at the account this morning, and they are obviously correct and I have received a months pay in Nov, Dec and Jan that I shouldn't have, approx adds to 5k.

    Now I am looking for advice on the following if possible:

    1) Do I have to pay back the 5k in full? I no longer have that money, I'm assuming that is how i have managed to over pay on my credit cards each month!

    2) If they have been paying me, and also the agencies have been paying me, surely i have been taxed a larger amount, so if i have to pay back the 5k, who pays back my tax? Or otherwise wouln't i have paid double?

    3) Do i need to take legal advice on this, if so who should i contact?

    I'm not sure what to reply to them letter/speak directly? Hoping someone has first hand experience of a situation like this, and can point me in the right direction.

    You did question whether you would have to pay the money back though. In regards to the tax, you best wait for your P60's from both the agency and your old employment and deal with it then. The accountacy firm will deal with any bookkeeping their end and PAYE payments their end, they'll just claim the overpayment back from HMRC.

    I had the exact same thought, if you didn't know it was in your account, how come you ended up using it?

    You stopped working for them, stopped using 'A' bank account, and instead used 'B' bank account with your OH.

    If that is true, which is what you have said, how on earth has the money been spent?

    You haven't used that account since you left so surely the money should still be in there?

    If it's not, then you have spent it and HAD to have known about it.

    I don't know whether you can pay them installments or not, but come on, please don't say you didn't know about it when you did.
