Rockwell Debt Collection

Hi there, I took out a loan back in 1998 from HBOS however was not able to meet repayments which I defaulted on. 6 years later my default was removed but I have not heard anything from the creditors since. All of a sudden, I received a letter from Pace Forward saying I owed money. I can confirm the debt is now Statute Barred and I replied with a letter stating this. Then Rockwell wrote me a letter to confirm that it is statute barred but they can still chase for payment and put a default on my credit file. I then sent another follow up letter which you guys kindly gave me....

However I got an alert from Experian saying that there was a unrecorded search on my credit file..... Guess who? Rockwell Debt Collection AKA Tessera Credit Services Ltd

Are they allowed to do this? I have contacted Experian and they are now investigating as I said I have no dealings with them and explained the Limitations ACT to Experian.

With a SB debt you do still owe the money. So whilst they have to stop debt collection activities I think they may argue that they would be entitled to do this unrecorded search. But they certainly cannot enter a default.

See what experian say, but I doubt there is much they can or will do. Nobody can see the search except you (and experian) and it did happen so to remove it would be inaccurate as its there to let you know they looked at your file.

Let us know what Experian come back with.
