Defaults

Options
Hi

I have a post open in the Mortgage & Endowment section at the moment about my husband's mortgage application. The issue is that I have a couple of blips on my credit file, namely 2 defaults from 2 creditors. I was paying them through a DMP (Payplan), they logged a couple of late/missed payments then defaulted me then the month after I settled the account. Is there anyway to get these defaults removed? They knew that I was using Payplan but they wouldn't accept my payment plan. Anything I can do about this?

Cheers

Unfortunately there is no physical way of 'removing' the defaults from your credit report. Once they are defaulted they are there for a minimum of 6 years wether in 'default' or as settled. All you can do AT BEST once they are on there is get them paid so that they get marked as settled. This will look better than a default - but it will still show you had problems in the past as it will still appear as a default unfortunately.

  • Thanks. They are settled, were done in 2006, so I guess we will have to wait until next year to move :(

Do they show as settled defaults now?

Once you start paying reduced payments (through payplan or whoever) they are entitled to send you a default notice and register a default against you.
Did they send you a default notice in the post and if so when was that dated? If you settled within the timescale shown on the default notice (usually 14 or 28days) then they should not have filed a default.

There are cases where default notices are issued, but the default is not actually put on file for months after. Perhaps that it what happened in your case, and happened to cross with you settling the account.

If you believe you didn't receive a default notice then contact your creditors and ask them to send you a copy of it. Or dispute that they sent one. Unfortunately they only have to prove they sent it, not that you received it.

Hi Tixy, yes they were settled a month after the Default was logged. They were partial settlements though and both accounts were then closed.

Sorry - I read that they defaulted you a month after you settled not a month before you settled, my mistake. That makes more sense.

As said then, nothing you can really do but wait for the defaults to come off.

You say this is your husbands mortgage application rather than a joint one? What financial credit accountsdo you have that are joint? if you could close them (if feasible) and then enter a notice of disassociation with the CRAs then your credit file should stop affecting his.

All we have is an application for a joint bank account that never went ahead and a credit card. He has just contacted Equifax to disassociate. Should we cancel my credit card that is a 2nd card on his account?

I don't think a credit card counts as a financial association, as its really just his card and he is liable for it, so it won't appear on your credit file. But the CRAs should be able to confirm.

You're right actually. It's only the initial credit search they did that links us so we have asked Equifax to disassociate us. Bet it's not quick though! Also have tried to apply for Experian but they are sending me a pin in the post! Why can't I do it online now like with Equifax!
