How long is too long - what next?

I am posting on behalf of my partners son. He had a loan with HSBC which for one reason and another has been passed on to Metropolitan Collection Services Limited.

They wrote to him back in late Dec 2010 and again in January he responded with a letter (7th January 2011) that I'd found mentioned on here asking for a copy of the agreement etc.

On the 21st January 2011 they sent a letter saying:

Thank you for your recent letter requesting copy documentation to the above account.

Please accept our apologies for the delay in responding.

We are not yet in a position to respond to your request. Once we are in a position to respond the relevant documentation will be issued to you.


I know there is a time frame that they should send this out? As its now more than a month since this letter what happens?

    If they don't send the CCA out then he could stop payments to them (although perhaps he isn't currently making any).
    They should stop debt collection procedures until they can locate the loan agreement. Once they send him a copy then they can resume them again.

    Should another/different letter be sent to them? As he requested the CCA on the 7th January and still it hasn't been found?
