LTSB and SCM

I've been passed from LTSB to SCM solicitors for my debt, with LTSB, I have 3 amounts of debt 2 account o/d and a c/c. I recently used to have an agreement in place on all accounts, but it fell through as I wasn't able to reach the branch after having baby in October. Since xmas I've been trying to put it right again sent them my income and expenditure which left me £26 between the 3 accounts so now I've said £5 goes to each of the o/d and the remaining £16 to my credit card. I told them not to ring my house as every time they rung they woke the baby as they managed to ring at the most inconvenient times and up to 10 times a day. But they never listened.
Now they are telling me I've made no effort to try and sort it and that even though I've made an offer now the credit card will be passed to a debt collection agency and the acc's will be closed. Can they do this since I've made offer of payment.
Many thanks in advance.

Yes they can sell a debt to debt collectors at any time after you have defaulted on your original repayments. You might actually find that it becomes easier to deal with once its with a DCA and they are often more likely to agree to freeze interest & charges.
After you made the offer did you actually then start paying the amounts you had offered?
Once you have made a payment offer whether or not they agree to accept it or reply to you its vital that you then start making those payments. To save the problem of having to go in branch could you set up standing orders to repay the debts instead?
When you say you offered £5 to each overdraft and £16 to the CC - is the CC balance about 3times what each overdraft balance is? If not then you should really offer to split the payment pro-rata based on the balance of each debt.
Have you actually written to them to ask for all phone calls to cease? or just asked on the phone? if you haven't yet written then send through the telephone harrasment letter here - http://forums.moneysavingexpert.com/showpost.php?p=11571485&postcount=4A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Hiya
Yeah I've started a standing order now to each of the three accounts the overdrafts are a grand each here or there and the cc is £3k. Ltsb have only offered to freeze the interest and charges for 6 months, and they said that in that time that my cc will go to a debt collection agency.
I did send a letter recently asking the phone calls to cease but they never listened funnily enough tho I haven't had a phone call today rather odd. But I'm not complaining lol0
