mortgage problems - what next?

Options
Not sure whether this is posted in the right place......... if not apologies,

we took out a new mortgage a short while back as we were moving house, the bank agreed to lend the difference we needed to borrow and add an existing loan into our new mortgage.

THEY DIDN'T LEND US ENOUGH MONEY

This has been going on for months now, and it has now been passed on to the ombusman, as the bank wont even accept their mistake, even though we have the original mortgage agreement which says we are right.

Meanwhile, they told us they would put a hold on the loan which should have been included, meaning we wouldn't have to make repayments until everything was sorted, but they didn't, so they've carried on taking payments and overdraft fee's leaving us with a very bulky overdraft, no one we speak to seems to have enough authority to deal with this and the people with enough authority never ever ring us back.

The money they've been taking is coming out of a bank account we don't usse anymore and because of the overdraft we're now getting letters telling us that the account is to be passed to a collections agency unless the full amount is paid in full in 7 days, we cant pay this and more to the point, dont fell that we should, we cant get any joy from speaking to the bank either, this is really starting to worry me now.. what would you do?

I'm confused, surely on the day of completion your solicitor would have made sure they gave you the right money, otherwise how did you complete? Your solicitor should have sorted it on the day.
