Equita and council tax arrears

hello guys, I need some help here, I have an outstanding bill that was 190 and as of last week was 261.50 with equita. I called last week and was told pay what you can but still with bailiff. Not made a payment yet, but this morning bailiff shows up and says he wants 440ish, that he hears what I am saying etc, but will run and check on my car and if mine will clamp. I am happy to pay the 261.50 but cant as have been directed back to him, but fear he may say he wants the 440 sum, which I am not sure is valid. Any ideas of what I can do?

    Sorry but you need to be precise.

    HAs the bailiff made a levy on your car? You will have a PIECE OF PAPER WITH THE REGIsTRATION NUMBER ON IT (oops).

  • No he has not, he came around this morning and said he would run a check and clamp the car if it was mine and I did not pay.

    I actually called him and offered to pay the 261 but he refused it and said the added charge was for him attending to remove, and he would be back tomorrow morning.

    If you have offered a sum of money to him and he has refused to take it. Then there is a serious problem
  • Well, I need to have a plan, I do not particularly want to be looking out every morning to see if the car has been clamped neither do I want to park a mile from home. He is adamant he wants £440 and not 261.50. So suggestions welcome :(

    is this your car? If so, you need to "sell" it to someone you trust - for £1 and get a receipt, by tonight.

    I explained to another poster that I used this info about once a week on here. Isuggest you add in a note that you have attempted to pay mr x so much and he has refused the payment.

    Please send a copy to the head of revenues at the Council (or whatever their title is) and to you local councillor, making sure equita know this.

    You need to WRITE to Equita or better still send an e-mail to:

    You need to say something along the following lines.

    I refer to the above account in relation to unpaid council tax due to xxxx

    As you will be aware from your files this account has been assed to your bailiff Mr xxx to enforce.

    The query that I have is concerning the amount that your bailiff is now stating is due. You will be aware that your bailiff visited my premises on xxx and for this visit I am advised that Mr xxx may only charge a fee of £24.50 for "attending deliver the first letter".

    He states it will be...

    As a matter of urgency can you please provide a full and detailed breakdown of the charges made by your bailiff.

    you cant sell the car now as the bailiff will do a dvla check this will confirm ownership as of the date of the dvla check and could be seen as you disposing of assets

    bexley council use a firm called Capita to administrate your council tax Equita are part of the Capita group

    as of today you owe £190 council tax and £42.50 bailiffs fees if you can pay this today on line do it

    then send both Equita and your councils chief executive a Formal complaint just outline what happened
    1 the bailiff is demanding £xxx for an outstanding debt of £xxx there has been no seizure of goods to date the bailiff refused payment in full as he wants to confirm ownership of your car before he re-attends to levy distress

    The Council Tax (Administration and Enforcement Regulations )1992 (amended ) Regulation 45 Schedule 5 charges connected with distress clearly state that the only fees due to the bailiff at this stage of enforcement are 1st and 2nd visit fees total £42.50 therefore you have now paid this and the outstanding council tax and you require e-mail conformation of this or a breakdown of fees charged by bailiff Mr xxx as he is claiming £xxx in bailiff fees with no breakdown as to what the are for
