I had received two letters under my name, my address, same orginal company name(Shop direct), but with different Lowell reference, different Shop direct account number and different amount money on Lowell letters in the same time. The total debt show on both letter is arround £1600 in total. But i have no knowledge about Shop direct before, and I absolutely didn't owed them money.

I paid for 14.99pound to check my credit report on credit expert, it showed that on previous seraches that Lowell serach me lots of times, but my credit report did not have any financial link to 'Shop Direct', and my credit score was near excellent stage as it is near 1000 score on expert website. what amazing!!! is there anywhere i need to pay attention to check in my credit report if it show some debt? thanks!

Please tell me how should I sent them a letter as lots of people said that I should sent them 'prove it' letter, it there such prove it letter asking 'don't phone me anymore and everything must by written letter ',how should mention that in letter? thanks a lot!

  • I changed a little bit of prove it letter, is this good enough to send?

    Dear Sir/Madam

    Ref:
    xxxxxxxxxxx

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

We would point out that we have no knowledge of any such debt being owed to
    The Loan Company.

We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I therefore request that no further contact be made concerning the above account unless or until you can provide documentary evidence as to my liability for the debt in question or your written confirmation that an error has been made and this matter is now closed.

Please note that I will only discuss this matter in writing for the purpose of proof and accurate record keeping. Under no circumstances will I discuss it on the telephone or doorstep.

We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

We look forward to your reply.

    Yours faithfully

Do you think you might have had any only debts from years ago that were not fully paid? Shop direct is lots of different catalogue brands, eg littlewoods, kays etc.
Just because a debt is not on your credit file does not mean that it is not your debt. If it was your debt it could be it never appeared (a lot of old accounts don't) or it could be that it was defaulted so long ago it no longer shows, or it could appear on your file with one of the other CRAs).

Your prove it letter looks fine. Usually the standard letter is fine but I don't think your changes will affect anything in terms of admitting liability. By itself I don't know that it would necessarily stop them calling you if they had your number but its unlikely they have it anyway.

Probably a case of mistaken identity then, or they are looking for someone else with the same name as you. Sending the prove it letter is the way to go. They'll either disappear or will send you paperworkfor the debt, which you should then be able to use to demonstrate you are not the debtor they want.
