CCJ after default

Hi all,

I have been trundling along with my DMP plan for a while now. It will run for longer than the 6 years the defaults and (one so far) CCJ will stay on my account for. I just wondered, if you stick to the monthly payments, can (and do) creditors still apply for a CCJ later on? Or is the general concensus that if they don't apply for one early on then they aren't going to?

I am stuck in my current mortgage because of my credit history but would like to think I will be able to remortgage once the bad bits have fallen off my credit file, so I don't want to get stuck with later CCJ entries.

Has anyone experienced having a default and then being taken to court and given a CCJ years later?

    Depends really.

    If you ended up on a long term DMP with the debt not going down very quickly, then it's possible a creditor may eventually decide to go for a CCJ in an attempt to get a change on property etc.

    As always, it's individual companies and circumstances that matter, so not easy to predict.

  • Ok, thanks. I suspected that it might be a 'depends on the circumstances' type answer. I've just started to panic that actually, I may not ever be able to remortgage my house! I swear I spend all my life thinking about debt now, I can't wait until it's over and sorted!!
