Hello fellow debt busters!
I have posted previously regarding an old debt I had with Intelligent Finance who have sold the debt on a number of times.
I took a loan out back in 1999 and fell behind on my payments and defaulted.
Long story short, the debt appears as being satisfied on my credit file (according to Equifax) but 1st Credit from out of nowhere have started to chase me for payment of the account.
Do I still owe money or not?!

Presumably it's been over 6 years since you last made a payment or acknowledged the debt in writing?

The problem was the debt was passed around 3-4 odd collection agents in quick succession so I wasn't able to even pay anything for the first 2 odd years.
Acording to 1st Credit, I made a payment to them to "hold" the account back in Sept of 2009. I hadn't long moved into my new house at this point and everything was up in the air for me at the time. They haven't chased me for any money at all up in till 2 weeks ago. I asked them to provide me with a writted credit agreement and explained that the debt is no longer outstanding as per my credit file to which the wonderful chap snarled "It doesn't matter what your credit file says!"0 -
He's right that it doesn't matter what your credit file says (in terms of whether you still owe the money).
If you paid in Sept 09 then the only way it would be statute barred is if there was a period of 6years before Sept 09 when nothing was paid. Do you even agree that you paid them in Sept 09? does that sound right? Its no unheard of for DCAs to make up such payments hoping you won't check.
If you want a copy of the original credit agreement you need to write to them and enclose a £1 postal order (they won't send it if you just ask by phone).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
I have since changed bank accounts so I have no way of knowing if I paid them. I had two accounts with them (both for IF.com) and one of them has been on a payment arrangement for quite a long time now. All I can think is that I never intended to pay to this one!0
