Hi there, I took out a loan back in 1998 from HBOS however was not able to meet repayments which I defaulted on. 6 years later my default was removed but I have not heard anything from the creditors since. All of a sudden, I received a letter from Pace Forward saying I ower money. I can confirm the debt is now Statute Barred and I replied with a letter stating this. Then Rockwell wrote me a letter, please see below. Just wondered if they are allowed to default me twice on the same debt?
Thank you for your letter received in our offices on 14th February 2011.
We acknowledge that your account is statute barred. However, this does notmake the agreement void.
Whilst we are currently unable to take legal action to enforce the balance this does not affect the vadility of the underlying debt; therefore as the debt still exists we are entitled to carry out any actions that do not amount to enforcing the agreement including the following:
Demanding payment
However, our client is willing to consider a significant reduction to the outstanding, in order to bring this matter to an early and amicable conclusion. We can consider any offer.
On your current outstanding balance (£1246.95) we can guarantee a massive 70% saving leaving you to pay: £374.08 but dependant on your individual circumstances, this could be much better! Call us immediately on the number above to find out more.
This offer specifically relates to our client's account under our reference as stated at the top of the letter.
If no further contact is received within the next 14 days further collection activity will continue.
