This is part of a longer thread I started some while back. That thread was a little too big so I've broken it down.
Mobile phone bill - ran up by son (he is helping with this) but in my name and it surfaced about 2 years ago just as he and I were laid off. (Doesn't that always happen !)
Few months of discussion with TMob who then handed it to Direct Legal (DLC). Few months of discussion with DLC and we (DLC/me) agreed on £15 pcm. Since then I have paid on time every time.
Almost - last Dec 2010 I sent £10 not £15 (not sure why) but the letter arrived from 'Scotcall' Massive :huh: It appears that throughout the discussions with DLC - including the agreement and all payments - DLC were not actually involved but just passed the cash etc across to Scotcall. If I hadn't paid the £10 by mistake I wouldn't know !!!
Scotcall are now leaning for an increase on the original agreement and upping the anti a bit. MY THOUGHTS are that the agreement I had with DLC is invalid as far as Scotcall v Me are concerned. Thoughts. Thanks

I would consider making an offer of payment that is affordable to you to Scotcall - use a financial statement (and send them a copy if you wish) to illustrate your financial position.
Some of the time creditors will not accept a formal agreements with you - try negotiating through your local CAB if they refuse.
The bottom line though is that you cannot pay more than you can afford so even if they refuse the formal offer - continue to make the payments anyway (they won't refuse them).
At the end of the day this is a non priority debt so point out that you have used the same process to determine your offer that the courts use and that you, at the moment, cannot afford an increased offer.
