Advice please

Hi all,
I owe £4100 on my CC for which the past 3 yrs i have had an agreement with them with interest frozen, It was for £113 per mnth, or firstly £70 per mnth then an hour or so later another call from them to say if i pay an extra £43 i could reinstate the ppi, well with the mental problems i had at the time i agreed, nothing was signed,
I have tried to reduce payments by telling them i want to cancel the ppi, but was told i can cancel but will still have to pay the full amount. Anyway im behind now by £339, so had a call from them last week demanding the arrears, i told them all i had in my acc was £90 then i would be on my overdraft limit, but i let them take it to try and pacify them (No chance) Soon as they had that they told me my debt is being sold. They wernt interested in dropping the monthly amount to an affordable £50, so i believe i can ask them or the new DCA for a copy of my original signed aggreement, is that still ok to do and is it still a £1 PO, How do i word it and do i sign it

bumping your post... I would speak to one of the free debt advisory services, CCCS, Payplan or CAB for advice. I am sure more knowledgeable people will come along in a minute. It is quite a few years since I paid off my debts (a dark time) and the landscape is different now.

Any more advice from anybody please ? dont have the confidence due to past illness, to contact CAB etc just at the moment but believe i will have to when the bat and ball game starts with CC people !

Hi Doug, Hopefully someone more knowledgeable will be along soon.
But I take it you were not able to use the PPI to cover your Illness.
If that is the case then the PPI was probably mis sold and you should not only be able to cancel but get the premiums back.
As they say they are now selling your debt on, I would tell them to put that in writing and tell them you will only make a £1.00 token payment. See what happens and then if they proceed wait until you hear from the DCA then request your CCA (consumer credit agreement). The cost is still a £1.00 PO.
As I said someone better placed to advise will be along soon but this will keep your post on page 1.

Thanks very much Handy, its avery long and complicated story, but basically the illness i had, and still have tho under control now, made me very laid back due to tiredness and everything was an effort to sort out, but when i applied for the CC i didnt want or get ppi, but sometime after i saw that i was paying for it, but in my state of mind i thought i would carry on paying and then claim it back after a year or so, a form of saving, i thought, but then i got ill but was on full pay for 6mnths then half pay for 6mnths from Oct 2006 till Sept 2007, when i lost my job and house that went with it, anyway i then defaulted on payments Mbna got in touch and we agreed to freeze interest and reduce payments, they informed me to try and get an insurance claim backdated, and i was successful in that, so that obviously will make things harder to reclaim the insurance but we will see ! main thing now is to get the payments further reduced to something more affordable.
