DMP with the CCCS/Moorcroft debt agency

I am in £9,000 debt with various companies and this morning recieved a visit from a debt collector from Moorcroft debt collectors..

The man was rather abusive to my dad who answered the door and refused to leave the property until my dad threatened to call the police i wasn't at home when this happened.

Are they allowed to get away with this ?

I live with my parents and revieved no prior warning about this visit and don't want the stress put onto my parents.

I have just completed a DMP with the CCCS is this the right step for me ?

I have also contacted CAB to make an appointment.

The debt collector has now said it will go to court as i wasn't there to speak to him.

    Hi and welcome to the forum,

    Unfortunately the majority of debt collection agencies are cowboys and bank on people being frightened enough to believe everything they are told. I know some of them send a letter threatening a doorstep visit which you can send a letter for, but have not experienced any of them turning up and then being idiots. I think a dmp with cccs is an excellent step forward, as there are no fees and all the money goes towards your debts. You will probably get loads of calls/letters eventually with debt collectors threatening everything up to, but just short of death, when in reality, they'll usually do very little. Keep making regular payments and things will settle down.
    If you've nothing decent to say, perhaps you shouldn't say anything.

  • I had a doorstep collector turn up just when I started my dmp and he got told to sling his hook.

    It's unlikely they will take you to court - it will cost them money to do so and they know that judges may look favourably on you as you are making every effort to clear your debts. Creditors are mostly full of hot air and bluster.

    CCCS is the right thing to do and keep paying that way and the creditors will eventually settle down. You just have to ride the storm for a while.

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    If you cant make the min payments then a DMP with CCCS sounds like the right step.

    Moorcroft usually work for Egg, so if they are one of your creditors then thats who they are working for... I have hundreds of letters from Moorcroft - even when paying every month I got 2 letters a month.

    Definitely write to your creditors and give them your CCCS reference and tell them from now on to deal with CCCS. And the letter above would be worth sending too.

    IMO the court threat is just that. I have never paid at the level Moorcroft/Egg wanted; I manage my own DMP and just wrote to them at each change in payment (payments went down as well as up lol) and paid them monthly by recurring online payment and despite LOTS of court threats it didnt make it to court. They cannot have what you dont and they know a court wont order you to pay more. Plus if they did take you to court they can no longer pursue/harass you; they are bound by any judgement just as you are :D

    Where as I agree most dont take people to court, a lot now are. When they take you to court it does not cost them, it costs you as they are added to the judgement.

  • Remember that until a court order is granted, DCAs have less legal standing than the paperboy. Tell them you are communicating in writing, will not accept phonecalls or doorstep visits and will consider their attempts to stalk you at your home at harassment and call the police. Then close the door. It's still chilly, they'll leave when they get hungry.

    Oh, and point out to them that any discussions they enter into with your parents or any person who may or may not reside at the address will be considered a breach of the Data Protection Act on their part, and will be reported to the OFT.
    Some days, it's just not worth chewing through the leather straps....

  • Hi,I had a man turn up at my door last friday from moorcroft,he said he would be back tomorrow and has txt me to confirm he will be here if im goin to be out to leave it by my bins,althou i owe the money i was actually trying to come to some sort of agreement to pay it off wiht the company at a cost i could afford to make every month, i agreed to pay £40 per month with this man just os hed go away as i had family visiting at the time an didnt want them to know i had someone after money at the door,i was not shown any I.D he just had a moorcroft letter that i could see my name and address on but he didnt show me it,what should i do? I cant afford the £40 i hastly agreed to last week :-( Im sorry for adding my post to yours but i cudnt see how to post my own lol .. could someone please tell me how to lol many thanks

    Near the top of the "Debt free wanabee" page on the left, is a "New Thread" button, click that and you can start your own!

    To answer your query, send them the letter that I posted for Owenwales and if the guy comes around again, tell him that you will not deal with debt collectors at the door and if he does not leave, you will call the police. (which you have every right to do, he has no right to be at your door whatsoever)

    Also, write to Moorcroft, detailing what you CAN afford to pay and enclose a payment with your letter (remember, recorded delivery and keep a copy)
    Do not set up any direct debits with Moorcroft and definitely do not give them any bank account or card details. Otherwise, they may be able to help themselves to any money in your account. Offer to set up a standing order, if they won't accept this, just send them a cheque/postal order every month but do make sure that you make regular payments. If you cannot afford to pay for any reason, write and let them know.
    Don't be bullied by this lot, they are not bailiffs, despite what they may imply. And let's face it, anyone who tells you to leave money out "by the bins" is surely a complete idiot!
