HI guys, well it gets worse - is that possible?
Spoke to ACAS first thing this morning, who agreed with what Hanxx had said re stat dismissal procedure guy recommended speak to union. Spoke to Unison rep at Council when I got into work - he said what acas guy said, can't do that, haven't followed procedure. He said he'd speak to HR and arranged to see me a 2pm.
Have just come back from seeing him and feel that everyone is just covering for everyone else. Unison guy said that as I work for a School I don't work for the Council and that as this is a temporary contract they can do what they ahve done, my supervision meeting can just be a way to say you're not being kept on, and they don't have to warn me in advance. I tried to argue with him that I have a contract which clearly says..... (this is a direct copy of the words used).....

Now to me this looks like I work for the LA and have continuous service from 23.2.05. Am I going mad or are they all just in it together.
The unison guy tried to get the Head to agree to the Councils redeployment procedure (which does not apply to schools, but schools are recommended to use). So it needs the head to agree to put me on the redeployment scheme, which would mean any jobs I wanted I would automatically get initerview. BUT guess what the head said no - the unison guy said he was nasty about it and said it was obviously a person thing.... the unison guy has spoken to HR who say there is nothing I can do, but the unison guy can keep pushing my name forward for jobs as though on the redeployment.
I haven't sent the letter to the governors, coz I don't know know what the point is.... I'm sitting here crying so much I can't see. Have spoken again to ACAS who say I need to get legal advice as I have the contract above. OH MY GOD. and i've got to still go in for the next 6 weeks.

Unison are wrong on this. Your contract is clearly with the council and I think they may be getting muddled up with the different type of schools and who employs their own staff and who does not. It has caused problems ever since schools first had the opportunity of running themselves and when you get a borough that is mixed with schools that run themselves, schools still under the umbrella of the borough and church schools, it does get confusing.
The issue of whether you are contracted to the council or school is one that always comes up but IMO your contract is clear and as such, I don't see how the school can terminate your employment or interfere in your redeployment. Your contract ends in December. It is there in writing.0 -
thanks bossyboots, I thought this to, it's not as if wehre a church school, we are bog standard county primary school, we take anyone, and as such I thought I was working for the LA. Am going to the CAB tomorrow with my contract and will take it from there.
I can't believe the hoops I'm having to jump thru to get someone on my side. I just feel like curling up and giving up,
but that's not an option, we've two kids under 8 and bills to pay, I know I can get a job, I know I'm good at my job, (at present I feel like I can't do anyting right, but that will go). As the saying goes "Lifes a b***ch and then you die". 0 -
Just to up date, have been to the CAB this afternoon, and the guy spoke to an employment lawyer in a centre in Liverpool who said I am employed by the COuncil, so I'm gonna get back on to Unison and take it from there.
BUT on the positive side,I applied for a job on Thursday afternoon after all t his carryon and they just phoned offering me an interview for Friday of this week!!!!! HURRAY.:j

If you get asked at the interview why you want to leave your current job try not to let them know about your problems in this job though as you don't want it to work against you.
(Even though it isn't your fault, when people ask for reasons they don't usually want the truth if there are problems with people - they usually want you to say you wanted something a little more challenging or similar answer).
Maybe you'll look back soon from a brilliant job in which you are happy in and be glad that your contract wasn't renewed!

Yep, I would just say you are leaving the job because the temporary contract has ended.
Regarding the issue of who you are employed by, what does it say on your contract of employment? I work at a Church school and I am employed by the Governors of the school although my pay slip comes from the Council. Also, remember that you were redeployed before and I don't see what has changed to stop you being redeployed again.

The extract from the contract above does indicate to me that she is employed by the council.
Many schools buy in payroll services from the council. Could this be why you get your slip from there?0 -

YEAHHHHHHHH!!!!!! guys I had an interview this morning, for the job I mentioned above. Its a higher grade and more hours and I GOT IT.:j (that's how c**p I am at my job). Subject now to references and a medical - I've got the Deputy Head at my first school and the Bursar (my current line manager) at this one to give me the references, so should be no problems there.
I am soooo happy. Thanks for all your support during this horrendous 10 days.:beer:0 -
