court action for a nil balance

reliable collection keep sending statements for a NIL balance, with debt paid up September 2011. Numerous phone calls they said they taken hubby name off the their data

To day we got a letter threatening court action, which can result in debt collecters calling, baliffs, charge on property, etc..

We phone them they stated its an error, l can write to them,asking how this happen.. I am thinking of it, also reporting it to the OFT, l am not sure what law breaking they done to the code on debts etc.. any advice please, l am angry to say the least, we both are pensioners, and in ill health.. we can do with out this worry.. thank you for your time

    I don't know the answer, but have you thought of going to the CAB? I am sure someone with more knowledge will post soon.

    Why don't you just try sending a payment or cheque for 1p - it may work

    I was going to suggest sending them a cheque for £0.00 in settlement of the balance.

    But really, I don't think the OP has got anything to worry about. If the collection company ever did get to the stage of initiating legal proceedings for a debt of £NIL, I imagine that it would (literally) be laughed out of court.

    OP might consider contacting their local paper. They might be interested in a story about a pensioner couple being harrassed for a debt that doesn't exist. Might get a bunch of flowers out of it.
