6 years has passed....

Checking my credit report yesterday i realise 2 companies are still there, one should of gone 12/12/2010 and one in November, both are still there and making me look bad.

I called one company who want it in writing, and i am a bit nervous about calling the 2nd as they are still sending 'we will send a balliff' letter even tho officiall they know and i know it is now statue barred.

what is the correct way for these two companies to be removed properly off my credit list.

I must add the second company keep changing dates on my credit info, what was 2004 is now 2009

    If so, then take it up with the CRA.

    sorry yes 6 years from last known contact with them,
    the one i contacted admitted that the account is 'settled' but want it in writting.

    CRA do you mean credit ref agency?

    Sorry, yes. CRA = Credit Reference Agency.

    The CRA keeps the defaulted accounts on your file for 6 years from the recorded "default date".

    The default date should arguably be within six months of when you broke the credit agreement, but certainly no more than 6 months after the last time you paid or acknowledged the debt.

    So, although a debt is statute barred, it can under some circumstances legitimately stay on your credit report for 6 months or so more.

    All depends on the individual timing of what happened when with the accounts.

    What are the "default" dates recorded?

    ok the one i have not spoken to, we shall call bank.....

    Bank Date last deliquent 12/04, date updated 16/06/2009 (last time i spoke to bank was back in 2004) refused to speak to debt companies as i felt at the time that the bank let me down when i needed them and this is all bank charges £153.00
    no default date listed
    Status defaulted


    Other company we will call credit card.

    defalt date not given
    date last deliquent 12/04
    Date updated 12/06/2005
    date satisfied 29/12/2004
    status settled.

    just to add i just noticed on the 'bank' one
    payment history shows last payment from me being November 2004, that would of been around about the last time i had any contact with them i guess.

    Well, you need to challenge the CRA (Equifax I presume) as to why those are still on your report, and instruct them to remove them.

    Credit agreements: Six years from the date the account was settled, written off or defaulted – whichever happened first

    Have you checked your Experian file? They normally seem to be better at reporting data properly. If they are on there, then they should have a default date.

    I have equifax, but will look into this.

    Many many thanks for your help, i feel a huge sigh of relief that i might be able to finally say i am debt free....

    But those 2 have been sitting on my chest for 6 years now so hopefully i can change my latest rating of 337 to something miles better.
