Hi Im not really sure if im posting on the right page or not, Im not too clever with computers and forums! I have a credit card with MBNA (which was a Ryan Air credit card) I was approached in an airport about 7 years ago about taking out the card, I filled in an application form and upon my return home a sparkly new credit card with a £4k limit was waiting for me (how lovely!) However after getting into a bit of financial difficulty over the last 3 or 4 years I got talking to a guy (in the money field) who said that MBNA destroyed all of there Consumer Credit Agreements years ago, and he felt pretty sure that because I was approached in an airport that I had only filled out an application form and not actually signed a Credit agreement anyway. I have since sent off the template letters (from this site) first of all requesting a true copy of the CCA, then a follow up letter after hearing nothing for 9 months. The original lender (MBNA) passed the debt onto Global Arrow who have passed it onto Frederickson International to act on thier behalf. (talk about passing the buck!) About a month ago I received a letter from Global Arrow with a copy of what they claimed was my credit agreement. It was a leaflet with no date and no signature on it and the address at the top (not in my hand writing) was my current address and not the address where I lived when I took out the credit card at the airport! I sent another template letter saying that they hadnt complied with my original request for my CCA. Today I have recieved a letter from Global Arrow saying that "we do not agree with your interpretation of the statute and we believe the agreement complies with the statute and we intend to pursue payment of the debt" They also go on to baffle me with saying that I can appeal to the courts for appropriate declaration ect ect! At the very end of the letter they say "This account is currently being operated on our behalf by Frederickson International. We will deal with this request only and all other enquiries should be directed to them" So I am now wondering what my next move should be. I couldnt see any template letters to follow up with to this reply from Global Arrow. This back n forth letters has been going on for nearly a year now and I would appreciate any help and advice on this to try and bring it to a close. Write to FI and tell them you cannot pay. I presume you can't? Ask them to issue a Summons in the County Court so that a judge can determine the debt and its resolution.0

My knowledge in this field is a little rusty (not been on the boards as much recently!), but if they haven't provided you with a valid CCA within the 28 days, everything is on hold until they DO manage to provide one.
As what you have received is obviously NOT a valid CCA, why waste your postage writing to them saying you can't pay? They are just trying it on and trying to scare you into paying (i.e. lying) - it's just what they do, and they are very good at it!
One question, though, who did you originally CCA request? If it wasn't Global Arrow/Frederickson International, then whoever it was shouldn't have passed the debt on in the first place, I don't think, as it was in dispute. There should be a template letter somewhere to send in this situation, but I can't remember where it is...
I'm sure someone a bit less rusty will be along soon to elaborate, though

I would go and talk to a debt advisor at your local Citizens Advice Bureau...they will contact the company on your behalf once u have given them permission to...its a free service and they are brilliant. Good luck!0
