Moorcroft Debt Recovery - communications

Hello all,

I am receiving letters from this company about an unpaid debt I have. It seems to be passed around to other debt collection companies (DG Solicitors, Central Debt Recovery so I need to know that any agreement I make is binding and I won't get chased by any of the others.

The other thing is that Moorcroft have asked for proof of income and a details budget. I could send them a basic budget, but I am not happy about sending payslips and any other documents with personal info on.

Although bankruptcy is my only long-term option (I can't afford the fees and can't find a way of raising them) I think I'll give them a take-it-or-leave it offer to keep them off my back.

Any advice or experiences of this company much appreciated!

    Are Moorcroft acting "on behalf" of someone, or have they now bought the debt? What is it for, and when was it first taken out?

    You say bankruptcy is your only real option. Why exactly? How much do you owe in total?

    Oh, and you have no reason to give Moorcroft any personal documents.

    In fact I would strongly advise against it. You never know where they will end up or what might be done with them.

  • I presume Moorcroft are acting for my bank as there is a client reference number on the letters which is my old account number.

    The debt was a loan, taken out about 4 years ago when I believe the bank badly advised me to consolidate my credit cards (which were then on a 0% switch!). I stopped repaying about 2 years ago when I could no longer afford repayments. I got into the vicious circle of using credit to make ends meet.

    I have been advised by CCCS about bankruptcy as I owe over £30k to 5 creditors.

    So the debt was taken out before or after April 2007?

    I might be tempted to CCA Moorcroft? If they don't own the debt, then they may just pass you off to the original creditor. I assume that is HSBC, since their 'pretend' solicitors DG have been involved?

    If you want to make payment offers, then I would try to get it passed back to the original creditor or at least their "in house" collectors. I wouldn't trust Moorcroft one inch with payments.

  • I would have to check but pretty sure it would be before April 2007. Sorry for my ignorance, but what is CCA?

    Thanks for the advice re Moorcroft, you're right it was HSBC (First Direct) so I may write to them or DG.

    CCA = Consumer Credit Agreement.

    The letter goes to whoever is demanding payment from you.

    I would be tempted to request it via Moorcroft first. They then may refer you back to First Direct or actually pass the account back to them if they have trouble getting a copy.

    The reason I suggest it, is that First direct?HSBC will normally say to you "talk to the debt collector, nothing that we can do now". So if you can encourage it to get properly passed back, then that is much better.

    As to what you might be looking for in a copy CCA, that is a rather involved question. The best thing would be to post a new thread on that if/when you actually get anything through.

    If you do send it to Moorcroft, let us know what they say in reply.

    They have a few template responses that are designed to mislead or worry you with legal nonsense, and try to obscure their responsibilities. If you get something like that then don't worry. Post back and ask. :)
