Problem with CC people

Hi, I have just come off the phone to MBNA, who have told me my reduced payment plan (£113 per mnth) is in arrears by 3 mnths, i pointed out to them that according to my bank statements for the last 2yrs, state that they are not, but i did miss Jan 11 payment, but believe that was because my DD was cancelled, not by me tho. any way they asked for £339, i told them i had £90 left in my account which is whats left of my overdraft (1050 a mnth) and said they could have all of that, which they took.
They then said my account will be sold and that i will need to negotiate a new monthly figure with whoever. When i originally agreed a payment plan it was £70 per mnth, they rang me back within the hour to say if i pay £113 that will reinstate the PPi, as i was recovering from a nervous breakdown and totally confused at the time, i agreed but honestly, and stupidly thought the extra was a one off payment ! so asked them today to cancell the PPi which they did when they put me thru to the dept, but said even tho i can stop paying the PPI i must still continue to pay the original plan but i thought that was the £70, i dont have anything in writing from them over this. I told them i just cant afford this but was happy to pay them £50 per mnth, but they wernt interested, do you think the debt collectors would agree to this even tho i cant really afford that, i did do a SOA on an earlier thread, to make matters worse we hope to be moving in April for health reasons but its going to cost another £92 per mnth rent. The original debt occurred through illness then job loss, and although im working again im earning a lot less than before. I know my credit file is wrecked but not to concerned with that, just faceing the heavies with a van worries me !! The sum involved is now about £4100.

Hi
Once a new DCA contacts you then you should just make an offer you can afford each month. They may well ask for a statement of affairs or for you to complete their income & expenditure form so make sure you can back up that whatever you offer is all you can afford.
If by chance MBNA don't pass your debt on, or you haven't heard from anyone by the time your next payment is due I would write to MBNA, again setting out that £X is all you can afford to offer monthly at the moment.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
