Overpaid by previous employer, should I have to pay it back ?

OP the fact that you kept quiet about it for 4 months and only started to worry about it when it was found shows your dishonesty. If you transfered £500 to the wrong bank would you expect the money back? or would you say, 'o my fault, never mind'
The fact you kept quiet about it shows you were never going to own upto it. you had 4 months to inform your former employer of their mistake instead you thought you would stay quiet and hope it kept coming in. How could you expect anyone to sympathetic to a thief?!0 -

Totally disagree.

O right, appologies, so when were you going to contact your previous employer?0

I honestly did not think it would go on as long as it did. I am NOT a dishonest person and have never stolen as much as a sweet from a shop and am offended at your accusations.
My original post has got a lot of peoples backs up, which I was surprised about. I am quite upset at how agressive people have been in their response and really wish I hadn't posted anything in the first place.0 -
You should have then been honest. Again its hard to sympathise, it couldve been resolved a long time ago but now your asking if theres a way out of not paying back their money. C'mon, that screams dishonesty. I have no wish to upset you further so i appologise and hope that in future, naive decisions dont leave you in this situation again.0

Your actions say otherwise.
Anyway, to echo previous posts: yes, you do have to pay it back. Your former employer does not have to agree to a repayment plan, should they so wish. They can ask for it all back in one go.
I suggest you get onto them NOW and see if they will accept instalments. Don't leave it.0 -

They can ask but there is nothing they can do to enforce this is the OP is unable to pay.
If they take him to court he will only be ordered to pay what the court thinks he can reasonably afford each month. It is as much in their interest as the OP's to agree something sensible.0 -
I will be contacting them to try to arrange repayment, but given my gross income is £6k and my OH is £14k with 3 young kids and childcare to pay, I cannot afford very much.
Clearly being totally skint all the time has impaired my judgement
