Anybody ever taken legal action against CSA for maladministration?

CSA Help - I take your comment on board - but what spooked me last Tuesday was that the guy was not being open with me, I have now been a parent with care for 6 months and the csa should be helping me, but the reality was that they were avoiding answering any direct questions about why nothing had happened in six months and began the "we are actually investigating you! line, and would NOT elaborate" I am so suspicious of CSA when their phone message says we may record you, I turn on my I phone recorder.
By a complete twist of fate, my best friend from youth club, is close to some of the most senior people in government. I broached my issues with him last saturday in the pub!, even if I knew such people can't get involved in individual cases, it feels like CSA even when they make mistakes, are untouchables.
If i were you i would ask the case worker to elaborate on what he meant by investigating you. I wouldnt be surprised if your ex has put her tuppence in also due to your new circumstances. I was reliably informed by ICE of when the pwc in my case contacted the agency regarding me for the smallest detail yet she blundered because of a crucial date on when she supplied information regarding her housing costs.0 -

CSA_Help, I had not really thought that the PWC may have said anything? The PWC has in the past not done anything to assist, and I assumed this is why it took so long to get the child benefit sorted.
I am not sure what PWC could say that would get me investigated?? or is that just me being naive!
Another point if anyone wants to comment, the CSA seemed to base everything on who gets the child benefit, but one of the sites offering paid help, it claimed this is not in the law the CSA use? It implied they just use it as a convenient approach?

The PWC may have just asked for a reassessment, so it could be that the case officer meant that your income is being 'investigated', however they would generally contact you regarding that.
When it comes to the CSA and Child Benefit, they tend to use it as a guide rather than the be all and end all...for example, in your case if the Child Benefit was still being paid to the PWC, but she agreed that the child now lived with you, then the case would close. However, if there is a dispute, and both you and the PWC are saying the kid lives with them, then the CSA will tend to look to Child Benefit and then side with whoever is in receipt of the benefit.0 -
The change of child benefit was requested in september 2010, and awarded to me mid Nov 2010, with the CSA saying that the child benefit were telling them it was still in the mothers name until end of Jan 2011.
At the beginning of Jan 2011, it then seemed a matter of closing the case so that I could make a claim as the new PWC.
But as i said in an earlier post, this is when the csa started getting mysterious! It would be rather odd of the historical PWC to deny that the child had moved in with me? especially as the child benefit showed a change made in mid November, schools informed ect ect. Theres no dispute...as far as I am aware!
So I sit here, the new parent with care, looking after my daughter :j, but bamboozled at to what the Child "SUPPORT" agency is well..doing!0 -
You are right, the name Child Support Agency is a misnomer. Levying an income tax on abesnt and excluded parentage has nothing to do with child support.0
