Illegible Credit Agreement
Options
This is with regards to a secured loan with Welcome finance, they are unable to provide me with a legible copy of this agreement. I have had a few bad copies sent to me plus enlarged copies and the latest thing they have posted me is a reconstitued version with no signatures etc and another copy of the ilegible agreement.
They have also pointed out and sent me a copy of a letter i wrote to them a couple of years ago pointing out that i had misplaced my agreement, I think by this they are saying that this is proof that it did exist, becuase i said id misplaced it.
The ilegible copy is virtually non readable, you cannot read the terms, the amounts or the t&c's, its all very blurry and unclear.
I have sent them all the template letters from this site following the 'illegible' agreement link and they just seem to keep sending me further copies and not acknowledging the letters i am sending them demanding repayment arranegment.
I would be extremely grateful if someone could give me some advice as to what my next step should be?
Thank you anyone for your help!

Why not show them your copy?
If you see this as a way of skipping merrily away from your debts you'd better think again.0 -
They do not have to produce an exact photocopy of your original agreement. It has been ruled by a judge that reconstituted copy is as good as the real thing.
Is there anything bothering you now about the terms and conditions of the loan that did not bother you when you signed on the dotted line and drew down the loan?0 -
When did you actually take the loan out?
Why are you asking for a copy of the agreement?Total 'Failed Business' Debt £29,043

Ask them what the illegible bits say then you can decide whether your demand for an repayment arrangement is legitimate or not.loose does not rhyme with choose but lose does and is the word you meant to write.0 -
What is the point of all this? It makes no difference if their photocopy is illegible. So, why create an issue out of it?I would be extremely grateful if someone could give me some advice as to what my next step should be?

Just pay your debts or get repossessed.0

Your original copy will have been put away deep in a vault somewhere.
They will have scanned it at the time it was put away.
This has then been emailed to somebody, printed and then faxed to somebody else when you asked to see it.
That quality is as good as you are going to get.
If it goes to court THEN they will bother to actually send somebody down to get the original out.0 -
Surely you would have read it when you signed it.
If it had been illegible then you would have said so.
And surely you recognise your own signature.
Looks like its pay up time.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Thanks for all your really helpful replies!
The reason i am asking for a copy of the agreement is becuase i do not have one. The copy they have sent me says that the amount borrowed £15K, the total amount repayable is £55K. This does not seem right. So am I so bad to request a legible copy? I do not trust these people which is why i want to see a copy of the ORIGINAL document and not a reconstitued copy. The reason i dont trust them is becuase these people have been bullies on the phone, one stage offering to meet me at my house to take me to the cash point to get the monthly repayment i was behind with. Harrassing telephone calls from a man who laughed down the phone at me when he had me in tears and said crying would not help me. This was all following loss of our 20 year family business and I was on antidepressents trying to cope. Their attitude was hurrendous - and as you have probably read from other people lots of others have had the same form of intimidation. I folded at one stage and had enough and said to them I was going to go bankrupt and they advised me that I couldn't. I was dealing with all my finances and just about staying ok with it all apart form them who were nasty and unfair.
So whoever has commented on my running away from my debts or hoping to skip away merrily i can guaruntee you that i wont be skipping merrily anywhere for the forseable future.
Why do i getthe impression some of these comments are from Welcome employees!0 -
Reconstituted agrrement has been deemed acceptable by the courts. You will need to look for a different approach.0
