Two CCJs for one Credit Card

Hi,
I have two defaults and two CCJS for one RBS Credit Card.
Firstly should there be two CCJS or just one, I have spoken to Lowell(the collections agency) and they have advised me that they chased for the whole debt (£1237) and then a smaller amount(£355, paid now to Lowell)
I also have two default notices on my credit file, one from RBS and one for Lowell for £355. This fee has been paid to Lowell
My question is, should I only have one CCJ and only one Default?
The second CCJ is 2008 where as the first is 2007. Obviously I would push to have the latter removed.
Any help would be great,
Thanks,
Dan

Where have you seen that there are 2 CCJs? Have you seen copies of both the judgements so you can see they relate to the same account?
If not I would start by getting copies of the county court judgements - you can request these from the court who issued the judgment.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
On my Credit Experian file. I rang the court(supplying both CCJ numbers) and they advised me that it was the same debt.0

Well I think you probably can have 2 CCJs but you need to find out what they claimed on the second judgement that they didn't claim on the first so you can understand if its the correct balance overall , and the reason for the second CCJ.
Have you paid up both CCJs now or just the second one?
The only way I think you could remove the second CCJ is by the set aside route if you could prove the money wasn't due.
However you can only have 1 default for the debt. It should either be RBS or Lowells but not both. I would say Lowell should not have added theirs without RBS removing the one the put on. Presumably both defaults are the same date? and are you saying they are both for £355?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
On the first they claimed for a partial settlement of £1237 and the second £355. The thing is Lowell have advised that £355 is the amount that was outstanding(now paid)
I have paid the £355 as that is what Lowell advised what was outstanding. Now that I have paid this do you think there is the chance to remove the latter CCJ?
Yes both were the same date and same fee.0 -
No I don't think so- it only gets removed if you pay within 30days of the judgement. You should get it marked as satisfied though.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
