Hello everyone..

Sorry I am back again for help!!!! we took out a loan which we thought was paid off completely.. with welcome finance yuck!!!

We have had letters from Incasso saying we still owe money I have sent them a cca request and the second cca letter account in dispute..

However they have come back yesterday with the cca signed but it's 2003 dated with a caution to our house..

Now I know we have not made any payments to this for over 6 years as we thought it was clear..

Can anyone tell me how we stand please

a caution to your house? was it a secured loan?
Have you got any paperwork from welcome finance saying it was paid off or anything?
It might be worth checking a) your credit files and b)with landregistry to see if you have a restriction or charging order against your house.
Did they get a CCJ? Normally with unsecured debts they would have to get a CCJ to get a charging order but not sure how it works with secured loans.
I would phone National Debtline for advice as well.

I have looked for the paperwork but can't find it at all.. I have now the cca which they sent me and yes it was secured but I havent made any payments to them for aprox 7 years thinking this was all paid I have had no letters from them until recently when incasso wrote to us..

No court order either... I am wondering if this can be statue barred or not as secured

I know that mortgage shortfalls can be chased for 12years before they become statute barred - I would imagine this would probably be the same for a secured loan.

Agree with df its probably worth clarifying with national debtline.
