My boyfriend keeps receiving letters from a company called lowell, who have now passed him on to hamptons legal, the letters are saying he owes about £1000 for a Barclay card which he never had. he has been receiving the letters since he moved into my house, which is strange because the debt was apparently from years ago. up until now he has just been getting rid of the letters, ignoring them but now it is keeping me up at night. so this morning when i got up, i opened the mail only to find ANOTHER letter from lowell about a capital one account, my boyfriend then told me he had a capital one account many years ago (about 10) but he knows he paid off all his debt and then cut up the credit card and heard nothing more from them. What should i do/he do. its keeping me up at night but this one company is now stalking us telling us we owe nearly £1500:mad: Help anyone...

I would get him to check his creditr records with the 3 agencies - this will ensure a) it's not identity fraud or anything and b) the debt collectors haven't started adding things to his files.
I then would send the prove it letter - hopefully someone can provide a link to it - it basically says I don't owe you any money you need to prove I do (which they won't be able to).
Hopefully this will cause them to back off but if the persist he can threaten to report them to the authorities for harrassment.

Hi
He should start by sending the prove it letter http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2
and see what they come back with.
It sounds like he paid off the card but didn't actually cancel the account. So its just possible that there is a debt either from trailing interest or because a continuos payment authority payment was taken from his account after he paid off the debt.
Even if they prove there is a debt and it is his before he pays anything or agrees to pay anything then you need to read up on statute barred debts to see if the debt would be statute barred - if it is he wouldn't need to pay.
Even if he should find there is a debt that is hisA smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
