Natwest Retail Debt £375 - Cant be proved - HELP!

Hi there folks.

Had a loan with Natwest a while ago to pay off an overdraft which was settled in full - about £3600. I received a letter before Xmas 2010 from Wescot Credit Services saying I owe natwest retail £375.18!?
I wrote to them stating to provide me full details of what this debt was for and to provider me a copy of my signed credit agreement and any charges etc under the consumer credit act 1974. They said they were going to go back to the client (Natwest). Next thing I get an email saying it is no longer with Wescot.

A week later a letter from Apex Credit Management. Asking for the same debt. I reply with the same letter, they provide me with a postal address for someone at RBS to get a copy of the signed agreement and start asking me for signatures and passports to verify my identity (Im not providing these incase they use them for other purposes). I still havent heard anything from the person at RBS as I gather they cannot prove anything.

I have today received a letter from 'HL Legal & Collections' asking for me to pay the debt to Apex asap before COURT PROCEEDINGS start. I have 7 days etc etc. It seems nobody can prove I owe the debt and I have no recollection of it so I want proof and I understand I am entitled to this proof but it is just getting passed around a circle of debt collectors who cant prove it and it is really getting on my nerves receiving letters everyday.

I would really like some advice on where to go from here. Should I write to 'Apex' again for whom 'HL Legal & Collections' are acting on behalf of? Or should I contact HL Legal? Im starting to get really confused now and fed up. Some advice would be greatly appreciated. Sorry about the long post guys - just wanted to be clear so people can hopefully advise.

Thanks in advance.

Send the prove it letter to HL.

They are all clutching at straws - hence the reason it is doing the dca merrygoround.

Ignore the 7 day cobblers, it's a bluff.

Insist they prove the right to collect and show evidence that there is actually anything owed.

If they can't - tell them to do one.....;)

  • This is what I thought chippy - thankyou for your response.
But this will then be passed to another CA won't it?
Me and my partner are just fed up of receiving letters regarding this debt that nobody can prove - it's driving me up the wall.
