Bailiffs for previous occupants

It depends what they are collecting
Liability order(council tax) No they cant break into your house unless they have previously gained peaceful entry
Warrant of execution (parking tickets) as above
Magistrate court fine distress warrant(speeding) yes they can but this very very seldom happens
High court enforcement writ of fi fa (water bill) No they cant break into your home but they can break open any garage shed greenhouse not attached to your propertyI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

But the fact remains that they were for the previous occupant(s) - so how can it possibly be right if a bailiff entered to do a levy whilst the previous occupants were still around can be allowed to come back now there is a new occupant in situ - surely it can't be right or lawful?
I'd call the police myself if confronted with a bailiff for someonelse.

Most of the letters are addressed 'to the occupier'. Ones addressed to previous owner we have to open to get contact details for bailiff.
It is for a parking ticket, the previous owners are not registered on the electoral roll at this address and the vehicle in question is not registered on the MID to this address- the bailiffs say it is!
I have just phoned them again and they have said the bailiff shouldn't be coming here as it's not our debt- yes I said so can you stop it. Oh no she said that is up to the bailiff?!?
Company in question is Equita.

absolutely agree contact the police however the op asked Can they enter the property?
and under certain warrants they can
It also would not be the first time a vehicle has been clamped or removed before the bailiff done a DVLA check to confirm ownershipI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

You could e-mail a notice to [EMAIL="info@equita.co.uk"]info@equita.co.uk[/EMAIL] advising them that you are not the "previous owner" and that you have had repeated attempts and disturbances from their bailiffs despite advising that the person owing the money is not resident.
Tell them it has to stop, head the message "Formal complaint". Ask for a copy of their complaints procedure. Ask the courts for a copy of theirs and start kicking off.If you've have not made a mistake, you've made nothing0 -
I have every sympathy for you. I moved into my house 5 years ago in July and still get debt letters for the previous owner.
Whoever asked, no you are not legally allowed to open the letter as one of the people I contacted and asked that they amend the details told me. I told her that if there's a chance of bailiffs turning up at my house I shall do as I please:o
In the 5 years we have been here we have only had one person turn up at the door, and after a short discussion he was happy we were not the person he was after and went away.
I used to return all the mail to the return addresses marked 'no longer at this address' but it never did anything, the letters kept coming. When that didn't work I tried ringing the company. I was always told 'we have amended our records' but it doesn't stop the letters coming.
I made sure they were not on the electoral (not sure how its spelt!) role, there's not much more I can do really.
I now just bin the letters. From the little I can gather the debts must get sold on and when this happens a new letter gets sent threatening action, but nothing ever seems to come of it.
Interestingly, the other day a bank statement came through for them and I have also had a letter from a college they enrolled with saying the fees were overdue on a course they had already been on. I rang and wished them luck getting the money:o
I would try not to worry. Don't ring the debt company they pay no attention and you spend money on the call. I wouldn't return any post at your own cost either, why should you? I would just 'return to sender' or bin the letters and then deal with whoever turns up at the door, if they turn up.
I have vowed to either never move again or move to somewhere where they leave a forwarding address as our other house had this issue to, but that was a re-posession so to be expected.0 -
so the mail i am ignoring could result in someone rifling my garage--i have a rather expensive classic car keeping snug!-the dwellers never had ctax responsibilities-they were foreign studentsmfw'11 No68- 55k mortgage İO--little to nothing saved! i must do better.0
