Capquest for unknown debt

I received a letter from Capquest telling me I owed over £2000.00 for a dept I know nothing about, it was then followed up by telephone calls from them, both times asking for my date of birth which I refused to give, the first telephone call told me it was for a dept for a purchase I made at Curry's, the second, I was told that it was for purchase from B&Q, I advised them I have know knowledge of either of these and was told to forward £1.00 so a credit agreement could be sent to me, I wrote a letter stating I had know knowledge of any dept and enclosed a £1 coin, this morning I recieved my letter back from Capquest to resubmit my letter signed which I don't want to as giving them my signature may lead to all sorts of things, can anybody help me in what I should do next. :(

    Definitely DO NOT provide CrapQuest with a signature!

    You really need to dispute this debt entirely, as you have no knowledge at all of it.

    Doesn't sound like CrapQuest have much knowledge of it either, if they can't even decide who it was owed to. ;) :rotfl:

    There is a letter in the link below that totally disputes the debt, and requires them to provide proof that you owe it or "bog off".

    No need to mess around with requests for credit agreements or proof of you signature. They have to either put up or shut up.

    (On a side note, you are not obliged to give them a signature, even for the £1 request.)

  • I have now received a letter from a solicitor telling me that if I do not pay the amount in full by the 10th March I will be taken to court and further cost will be added to the amount outstanding which I have been told by Cap Quest is over £2000.00. I have sent another letter telling them I have no knowledge of the debt and again asking them to send me a copy of the credit agreement, again I have not signed the letter but this time printed my name, as I have not given them my date of birth it has not been confirmed that I am in fact the person they say owes this money.
    Any advice would be welcomed.

  • Thank you for taking the time to answer my thread, the solicitor is HL Legal and they say may be issued, the thought of them doing so is making me ill, I spoke to them today when they rang and went through it all again only to be told to send my letter & £1 requesting the credit agreement, the chap I spoke to told me the debt was taken out in 2003 which is 7 years ago, it just does not make any sense.

    Even if the debt is yours, if it was taken out seven years ago and there has been no payment or acknowledgement from you, then the debt will be statute barred. This company are not nicknamed 'Crapquest' for nothing, and they have a terrible reputation here.

    Did you get your £1.00 back too? I suspect that they will have used it as a payment towards this "debt" so that they can tell you that you cannot use the statute barred route (which is untrue.) I bet they will deny all knowledge of your letter too. :mad:

    Do not telephone these sharks again and definitely do not write and provide a signature. They may use it to cobble together a fictitious consumer credit agreement (by copying and pasting your signature) and your £1.00 coin will be used as a payment, which they will then say is proof that you have acknowledged the debt.

    Don't panic and don't make yourself ill over this rubbish. Send the letter that Fermi gave the link to and make sure that you don't sign it. It may be worth adding a sentence to the letter stating that your £1.00 is NOT to be used as a payment towards this debt and that as they will not be able to provide any valid CCA, they must return your money within (say) 14 days. Send the letter by recorded delivery and keep a copy.

    There's absolutely no chance of this reaching a court, if they cannot even agree as to whom the money is owed, they wouldn't be allowed anywhere near a court room with such a silly claim. :)

    Just reading... i spoke to these debt collectors today over the phone and they were very helpful for me. now starting to worry they will turn nasty. why do they have a bad rep around here?

    Listen to the advice, follow the links and guidance given by fermi.
    If you want to know why they and their tame solicitor HL Legal have such a bad rep use the forum and thread search tool and look them up.
    Try CrapQuest as well as all lower case.

    They are famed for illegal practice and flouting the law. If you know what you are dealing with they are quite toothless, and you wouldn't be the first innocent to be suckered into paying for someone else. Even if the alleged debt was yours it's over the Statute Barred Limit. You could if you wanted make them an offer, or tell them to do one.
